BI MEMORANDUM CIRCULAR NO. RADJR-12-013
PROVIDING FOR TRANSITORY GUIDELINES FOR THE IMPLEMENTATION OF MEMORANDUM ORDER NO. RADJR-12-007 (GUIDELINES ON THE CANCELLATION AND DOWNGRADING OF VISAS AND PROCESSING OF APPLICATIONS FOR GRACE PERIOD)
Pursuant to Memorandum Order No. RADJR-12-007 (Guidelines on the Cancellation and Downgrading of Visas and Processing of Applications for Grace Period) approved on March 5, 2012 by Department of Justice Secretary Leila M. de Lima, the following guidelines shall be observed:
I. Implementing Guidelines
1. Processing of Applications for Downgrading.
a. All applications for downgrading of visa shall only be processed under the computerized system similar to the Visa Issuance Made Simple (VIMS). Processing of any application for downgrading of visa under the Non-VIMS system in violation of this memorandum shall be administratively dealt with.
b. All applications for downgrading of visa shall be resolved and acted upon not later than twenty-four (24) hours from the time of filing in consideration of the assessed double express lane fee of P1,000.00. Processing of any application for downgrading of visa under the Non-VIMS system in violation of this memorandum shall be administratively dealt with.
c. Failure to stamp "no derogatory record" on the letter-request is not fatal to the application considering that the BI Clearance is equivalent to a no derogatory record stamp. Applicants will be assessed P1,000.00 for the BI Clearance. HTacDS
d. For applications of downgrading from pre-arranged employment visa (Commercial) and 47 (a) (2) visa (Working visa), the letter-request must be in a company letterhead (with address and telephone number) stating the date when the applicant resigned or was terminated from employment and the purpose for downgrading.
e. The Immigration Regulation Division (IRD) shall ensure that the Alien Registration Division (ARD) is furnished a copy of all orders for downgrading of visa.
f. The Alien Registration Division (ARD) shall deactivate or cause the deactivation of the ACR I-Card of all applicants who downgraded their visa, regardless if the original ACR I-Card was surrendered by the applicant.
g. The approval and implementation of a downgrading order shall not prejudice any action and/or prosecution of an alien for criminal liability and deportation if found to have committed fraud and/or falsification in securing any visa prior to the downgrading of status.
II. Transitory Guidelines for Applications for Downgrading of Visas
a. The Administrative Division shall cause the publication in a newspaper of general circulation of the revised and uniform fees for Downgrading of visas for two (2) consecutive weeks. The applicable fees to be published shall be as follows:
"NOTICE OF INCREASE IN FEES
"Php3,510.00 shall be assessed for applications for cancellation and downgrading filed on or before the date of expiration of visa.
"If the application for downgrading is filed within fifty-nine (59) days after expiration of the visa, an additional Php1,000.00 as update fee shall be assessed.
"If the application for downgrading is filed beyond the fifty-nine (59) days after expiration of the visa, additional fees shall be assessed. DaEATc

b. Prior to the publication of the revised and uniform fees is effected and completed, the assessment of double express, BI Clearance, and Certification fee shall be held in abeyance. If the applicant opts to pay the above-mentioned fees, his/her application shall be processed and acted upon not later than twenty-four (24) hours from the time of filing.
