Declaring Certain Portion of Lands of Public Domain as Part of the Expansion Area for Luna, Kalinga-Apayao

PRESIDENTIAL DECREE NO. 1088

DECLARING A CERTAIN PORTION OF CLASSIFIED ALIENABLE OR DISPOSABLE LANDS OF THE PUBLIC DOMAIN AS PART OF THE EXPANSION AREA FOR THE TOWNSITE OF THE MUNICIPALITY OF LUNA, PROVINCE OF KALINGA-APAYAO

WHEREAS, the fundamental aim of the government, among others, is the economic and social development of the entire country;

WHEREAS, the municipality of Luna, Province of Kalinga-Apayao which lies in the northern foothills of the Cordillera Mountains, bounded by ricefields and high mountain ranges, with an area of about 20,000 square meters and presently populated by 15,000 people, which land area is too small for a townsite; cdt

WHEREAS, the municipality of Luna needs a bigger land area to cope with the expansion of its present fast-growing population; and

WHEREAS, in order to promote the economic and social well-being of the community, the inhabitants should be provided with sufficient land for expansion purposes.

NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order and decree:

SECTION 1.  The territorial jurisdiction of the Municipality of Luna, Province of Kalinga-Apayao, is hereby expanded to include a certain portion of public land within the classified alienable and disposable area situated three kilometers south of the Poblacion and identified as within Sheet No. I, Project 7-D, Luna, Kalinga-Apayao, and more particularly described as follows:

"A parcel of land situated in the Municipality of Luna, Province of Kalinga-Apayao, bounded on the North by project No. 5, Block D, A or D, certified July 25, 1925 per L.C. 552 on the N.E. by Project No. 13, Block V, A or D certified February 21, 1923 per L.C. 30; on the E.S.,W, NW by portion of Project No 7-D, A or D, Block I (pending certification). Beginning at a point marked 1 on plan being identical to FZ corner 1 of A or D Block D, Project No. 5 of Tawit, Apayao.

Thence : Following branch of Cr. upstream 520.00 M. to point 2;

Thence : S 3ºE., 1,800.00 M. to point 3;

Thence : S 80ºW, 1,300.00 M. to point 4;

Thence : N 82ºW, 1,350.00 M. to point 5;

Thence : Following trail in a general northeasterly direction about 1,000.00 M. to point 6;

Thence : N. 25ºE., 1,130.00 M. to point 7;

Thence : N. 64ºE., 200.00 M. to point 8;

Thence : S 5ºE., 200.00 M. to point 9;

Thence : S. 5ºE., 130.00 M. to point 10;

Thence : Following trail in a general southeasterly direction about 200.00 M. to point 11;

Thence : S. 62ºE., 180.00 M. to point 12;

Thence : N. 82ºE., 120.00 M. to point 13;

Thence : N. 7ºW, 250.00 M. to point 14;

Thence : S. 54ºE, 400.00 M. to point 15;

Thence : N. 26ºE, 650.00 M. to point of beginning, containing an approximate area of FOUR HUNDRED HECTARES (400). All corners referred to are indicated on the plan."

SECTION 2.  This expansion area of the townsite of the Municipality of Luna, Province of Kalinga-Apayao shall be named and officially referred to as "BARO A KAGIMONGAN."

SECTION 3.  This Decree shall take effect immediately.
