CLARIFYING AND STRENGTHENING THE ORGANIZATIONAL STRUCTURE AND ADMINISTRATIVE SETUP OF THE PHILIPPINE JUDICIAL ACADEMY
WHEREAS, the increase in the programs and commitments of the Philippine Judicial Academy (PHILJA),hereinafter referred to as the Academy, necessitates an organizational structure and administrative set-up more appropriate to an academic institution; TSDHCc
WHEREAS, to implement fully and effectively the Academy's mandate under its charters, Administrative Order No. 35-96 and Republic Act No. 8557, clarification and further elaboration concerning its organizational structure and administrative set-up are needed;
WHEREAS, as part of the Action Plan for Judicial Reform (APJR),the Center for Public Resources Management, Inc. (CPRM) has undertaken an "Institutional Assessment of the Philippine Judicial Academy (Final Technical Report)" and has made some interim recommendations to strengthen the organizational structure and administrative set-up, including key operating systems and staffing of the Academy;
NOW, THEREFORE, the Court En Banc hereby promulgates this Resolution to clarify and strengthen the organizational structure and administrative set-up of the Academy. benchCDTA
SECTION 1. Professors. —
1.1 Corps of Professors
The term Corps of Professorial Lecturers in R.A. 8557 shall be construed to mean "Corps of Professors", which is the entire instructional force of the Academy i.e.Full-time Professors, Part-time Professors, and Professorial Lecturers.
Full-time Professors and Part-time Professors are two-tiered: Professors I shall receive Salary Grade 29. Professors II shall receive Salary Grade 30.
1.2 Definition of Terms
The terms Professor and Lecturer should be distinguished.
1.2.1 A Full-time Professor is one who is nominated by the Chancellor to the Board of Trustees and appointed by the Court, and who makes himself available for all programs of the Academy.
1.2.2 A Part-time Professor is one who is nominated by the Chancellor to the Board of Trustees and appointed by the Court, and who makes himself available on determined days for academic programs and activities of the Academy.
1.2.3 The term Professorial Lecturer, as used in Republic Act No. 8557, should be construed to mean "Professor."
1.2.4 A Professorial Lecturer is one who is nominated by the Chancellor to the Board of Trustees and appointed by the Court to any of the academic departments of the Academy, and who may be called on or invited to deliver lectures when his services should be needed.
As distinguished from the services of the Full-time Professors and Part-time Professors, the services of Professorial Lecturers shall not be considered as government service for purposes of retirement and entitlement to benefits granted by law to government employees.
1.3 Qualification Standards for Professors
1.3.1 Special Lecturer
• Principally Honorific
• Applied to incumbent and retired Justices of the Supreme Court
1.3.2 Professor II
For Members of the Bench
• An incumbent member of the Court of Appeals or the Sandiganbayan, or those equivalent in rank in quasi-judicial bodies;
• Retired members of the Supreme Court, the Court of Appeals or the Sandiganbayan.
For non-Members of the Bench
• Preferred: A masteral or a doctoral degree in law (over and above the law degree held by every member of the Bar);
• Minimum: Law degree and Membership in the Bar; without prejudice to the appointment of non-Members of the Bar with recognized expertise in law, juridical science or a field relevant to judicial education in exceptional circumstances.
Note: The Rank of Professor II shall be reserved for Members of the Bar or those who have completed advanced law degrees or degrees in juridical science in other jurisdictions.
1.3.3 Professor I
For Members of the Bench
• Incumbent or retired RTC Judge, or the equivalent thereof in a quasi-judicial body;
• OR: One who has been a judge for at least three (3) years and was honorably separated from judicial service.
For Non-Members of the Bench:
All qualifications must concur:
• Graduate degree in law preferred;
• Minimum: Law degree and Membership in the Bar; in exceptional circumstances, recognized expertise in field relevant to judicial education;
• Professorship in an academic institution for at least three (3) years;
• Recommendation by:
o The Law Dean
o A well-respected professor of law
o The Chair of the Curricular Department (per En Banc Resolution A.M. No. 03-7-14-SC dated July 8, 2003)
1.4 Tasks of Professors
Tasks of Full-time Professors and Part-time Professors comprise instruction, research, and course preparation.
In the exigencies of the service, they may be designated to administrative positions or assigned administrative duties.
A full load for instructional tasks shall be within the context of a full-time arrangement of 40 hours per week. On this basis, the minimum working time per week for part-time professors shall be proportionately determined. Time served outside the Academy but in its service and for its programs may be reckoned as part of instructional tasks.
1.5 Entitlements of Professors
1.5.1 The Full-time Professor shall be entitled to a monthly salary, and other benefits the Supreme Court grants.
1.5.2 The Part-time Professor shall likewise be entitled to a proportionate monthly salary, with a proportionate share in other benefits the Supreme Court grants. ISADET
1.5.3 The Professorial Lecturer is remunerated for every lecture delivered.
SECTION 2. Academic Council. —
The term Academic Council shall refer to the Department Chairmen.The Academic Council, presided over by the Chancellor,considers and approves programs, courses and activities of the Academy as recommended by the Academic Officials. It meets regularly once a month and as often as may be called by the Chancellor.
The Executive Secretary of the Academy shall be ex officio Secretary of the Academic Council.
2.1 Department Chairmen
The term Department Chairmen shall refer to the Heads of the Academy's subject areas which may be created by the Chancellor upon consultation with the Academic Council and approved by the Board of Trustees. Department Chairmen shall be nominated by the Chancellor to the Board of Trustees upon consultation with the Academic Council, and appointed by the Court. They shall be recognized authorities in the subject areas to which they are appointed.
Department Chairmen shall be entitled to an expense allowance for participation in each meeting/session of the Academic Council as may be approved by the Board of Trustees. They shall also be given appropriate compensation to be determined by the Board of Trustees, upon recommendation of the Chancellor, for the development of courses in their respective areas and for the discharge of such and related responsibilities.
When the Department Chairman is unable to participate at the Academic Council meetings, the Vice-Chair participates and is thereby entitled to the expense allowance. When the Chancellor or the Executive Secretary is informed of the inability of the Chairman to attend, the Vice Chair is invited to attend, and is, therefore, entitled to receive the expense allowance allocated. (as approved by the Chief Justice on April 30, 2003)
SECTION 3. Academic Offices. —
The following Academic Offices are hereby created:
a) The Academic Affairs Office
b) The Research and Linkages Office
c) The Judicial Reforms Office (formerly the Judicial Reforms Committee)
Each of the above offices shall be headed by an Assistant Chancellor, with appropriate academic qualifications particularly in law, and the same compensation and benefits as a Presiding Judge of a Specialized Court, to be recommended by the Chancellor to the Board of Trustees and subject to the approval of the Court en banc. The Assistant Chancellor shall serve for a term of two (2) years, without prejudice to subsequent reappointments.The Assistant Chancellor will perform line functions.
Until such time as the items of the Assistant Chancellors shall have been created, the incumbent Heads of Offices shall be designated as Assistant Chancellors.
Additional Academic Offices as may be necessary shall be created by the Court, upon recommendation of the Chancellor to the Board of Trustees, the Heads thereof to be appointed by the Court for a term of two (2) years, without prejudice to subsequent reappointments.
3.1 Academic Officials
The term Academic Officials shall refer to the following:
3.1.1 The Assistant Chancellor for Academic Affairs
3.1.2 The Assistant Chancellor for Research and Linkages
3.1.3 The Assistant Chancellor for Judicial Reforms
Academic Officials shall possess the appropriate academic qualifications, especially in law, as will enable them to discharge their functions as heads of the offices mentioned.
3.2 Entitlements of Assistant Chancellors
3.2.1 The Assistant Chancellor shall have the same compensation and benefits as a Presiding Judge of a Specialized Court.
3.2.2 A part-time Assistant Chancellor shall be compensated proportionately. Provision for part-time Assistant Chancellors with particular hours or days of service shall be made.
3.2.3 Academic Officials shall be remunerated for every lecture delivered, or for participation in academic programs outside of their duties as Academic Officials.
3.3 Secondary Units under Academic Offices (see Organizational Chart, Annex A)
3.3.1 The Academic Affairs Office
a) Judicial Education Division, to be responsible for the organization, management and provision of training for members of the Bench;
b) Court Personnel Education Division, to be responsible for the organization, management and provision of training for court personnel;
c) Programming and Monitoring Division, to be responsible for planning and establishment of a training delivery program, monitoring of its delivery and evaluation of its performance. It will also be responsible for academic records keeping and credentialing.
3.3.2 The Research, Publications,and Linkages Office
a) Research and Development Division, to be responsible for the formulation of a research agenda for judicial training and education, as well as its implementation and management;
b) External Linkages Division, to be responsible for the continuing exploration, design, implementation and management of mutually beneficial linkages with other institutions.
c) Publications Division, to be responsible for planning, marketing, production, and distribution of the Academy's research outputs. It shall also maintain Library, Research and Audio-Visual facilities.
3.3.3 The Judicial Reforms Office
a) Court Administration Reforms Division, to develop, evaluate and recommend measures for judicial reforms.
b) Mediation Management and Education Division, to direct and manage the PMC units and mediation chapters as well as to conduct the training and education in mediation of judges, court personnel, trainors, educators, lawyers, and officials and personnel of quasi-judicial agencies.
c) Reforms Linkages Division, to monitor and study, reforms initiated by other agencies/groups and submit appropriate recommendations.
3.4 Division Heads
Each Division shall be headed by a SC Chief Judicial Staff Officer or its equivalent position with Salary Grade 25. ISaTCD
SECTION 4. Executive Officials. —
The Executive Officials are the Chancellor, the Vice Chancellor, and the Executive Secretary.
Executive Officials shall be remunerated for every lecture delivered, or participation in any academic programs of the Academy outside of their regular duties as Executive Officials, in addition to their compensation as provided by law.
4.1 Executive Offices
The Executive Offices are:

4.1.2 The Office of the Vice Chancellor
4.1.3 The Office of the Executive Secretary
SECTION 5. The Administrative and Finance Office. —
The Administrative and Finance Office shall be headed by an Assistant Chancellor, with appropriate academic qualifications, and the same compensation and benefits as a Presiding Judge of a Specialized Court, to be recommended by the Chancellor to the Board of Trustees and subject to the approval of the Court en banc. The Assistant Chancellor shall serve for a term of two (2) years, without prejudice to subsequent reappointments.
A part-time Assistant Chancellor shall be compensated proportionately. Provision for part-time Assistant Chancellors with particular hours or days of service shall be made.
The Administrative and Finance Office shall be composed of the following secondary units:
a) Corporate Planning Division,to be responsible for the formulation of annual and long-term enterprise development plans for the Academy and for the monitoring and evaluation of its performance, other than academic performance;
b) Finance Division,to be responsible for the formulation, allocation, administration and accounting of the Academy's budget and sources of financing and other resources;
c) Administrative Division,to be responsible for the planning, management and accounting of the physical assets, records and other properties of the Academy, personnel administration and human resources development, and other logistical services.
SECTION 6. Budget. —
The amount necessary to carry out the purposes of R.A. 8557 and of this Resolution, including the operation, maintenance and judicial education activities of the Academy, among others, shall be part of the budget of the Supreme Court.
The initial funding necessary to implement the provisions of this Resolution shall be taken from the savings of the Court until such time as the required budget therefore shall have been incorporated in the general appropriations law.
SECTION 7. Grants and Technical Assistance. —
The Academy's authority under Section 13, Republic Act 8557, to receive "income, legacies, gifts and donations for the benefit of the Academy or for its support or maintenance" shall include grants and technical assistance that may be given by donor institutions, in cash, kind, or services, for PHILJA's regular or special focus programs and activities. Letters of Agreement entered into by the Chancellor with the agencies concerned shall be approved by the Chief Justice and ratified by the Board of Trustees.
The Academy may enter into consortium agreements with non-educational institutions in aid of its academic programs.
SECTION 8. Institutional Placement of the Academy. —
As the education arm of the Supreme Court, the Academy shall be considered as a separate component unit of the Court and operates under its administration, supervision and control, consistent with Republic Act No. 8557.
SECTION 9. Implementing Authority. —
The Chancellor is hereby authorized to implement the provisions of this Resolution and to call on such officials and personnel of the Court for assistance as may be necessary.
SECTION 10. Staffing Pattern. —
The staffing pattern of the Philippines Judicial Academy is hereby revised to include one hundred twenty four (124) new positions created to perform the functions of the new offices and divisions; and to realign the ninety-nine (99) existing positions to enhance efficiency.

SECTION 11. Effectivity. —
