Approving the 2016 Revised IRR of RA No. 9184 and the Consolidated Guidelines for the Alternative Methods of Procurement

GPPB RESOLUTION NO. 008-16

APPROVING THE 2016 REVISED IMPLEMENTING RULES AND REGULATIONS (IRR) OF REPUBLIC ACT NO. 9184 AND THE CONSOLIDATED GUIDELINES FOR THE ALTERNATIVE METHODS OF PROCUREMENT

WHEREAS, Republic Act (RA) No. 9184 entitled "An Act Providing for the Modernization, Standardization and Regulation of the Procurement Activities of the Government Procurement and for Other Purposes," took effect on 26 January 2003;

WHEREAS, Section 63 of RA 9184 authorizes the Government Procurement Policy Board (GPPB) to formulate public procurement policies, rules and regulations, and amend, whenever necessary, its Implementing Rules and Regulations (IRR);

WHEREAS, since the passage of RA 9184, the GPPB has issued two IRRs, namely: (a) IRR-A, and (b) 2009 Revised IRR, which took effect on 8 October 2003 and 2 September 2009, respectively;

WHEREAS, the GPPB issued Resolution No. 06-2015, dated 30 January 2015, creating the Special Technical Working Group (IRR Review Committee), composed of the members of the Inter-Agency Technical Working Group (IATWG), for the review and revision of the 2009 Revised IRR of RA 9184;

WHEREAS, the GPPB-Technical Support Office (GPPB-TSO) conducted eleven (11) Focus Group Discussions (FGDs) 1 with various government agencies, bidders and observers to gather feedbacks, suggestions and recommendation for the proposed revision of the 2009 Revised IRR of RA 9184. Stakeholders likewise manifested the need to provide an omnibus guidelines on the Alternative Methods of Procurement for ease of use and convenience of all stakeholders; cSaATC

WHEREAS, the IRR Review Committee convened five (5) IRR Review Workshops 2 to review and discuss the results of the FGDs as well as the proposed amendments to the 2009 Revised IRR of RA 9184, including the proposed Consolidated Guidelines for the Alternative Methods of Procurement (Annex "H" of the 2016 Revised IRR of RA 9184) as recommended by the GPPB-TSO and other member agencies of the GPPB;

WHEREAS, the IRR Review Committee, through the GPPB-TSO, presented to the GPPB 3 the proposed revision of the 2009 Revised IRR of RA 9184 and its Annex "H", as the result of the IRR Review Workshops, for the Board's review, consideration and approval;

WHEREAS, after a series of meetings, discussions and deliberations on the proposed revisions of the 2009 Revised IRR, the Board, during the 7th GPPB and 5th IATWG Joint Meeting on 10 May 2016, approved the 2016 Revised IRR of RA 9184 and the Consolidated Guidelines for the Alternative Methods of Procurement (Annex "H" of the 2016 Revised IRR of RA 9184);

NOW, THEREFORE, for and in view of all the foregoing, WE, the Members of the GOVERNMENT PROCUREMENT POLICY BOARD, by virtue of the powers vested on US by law and other executive issuances, hereby RESOLVE to confirm, adopt, and approve, as WE hereby confirm, adopt, and approve the 2016 Revised Implementing Rules and Regulations of Republic Act No. 9184 and the Consolidated Guidelines for the Alternative Methods of Procurement (Annex "H" of the 2016 Revised IRR of RA 9184), copies of which, are attached hereto as Annexes "A" and "B", respectively, and made integral parts hereof.

The 2016 Revised IRR of RA 9184 and Annex "H" thereof shall take effect sixty (60) days after its publication in the Official Gazette or in a newspaper of general nationwide circulation and upon filing with the University of the Philippines Law Center.
