Approval of the 2016 Revised Implementing Rules and Regulations (IRR) of Republic Act No. 9184 and Its Relevant Annexes

GPPB RESOLUTION NO. 013-16

APPROVAL OF THE 2016 REVISED IMPLEMENTING RULES AND REGULATIONS (IRR) OF REPUBLIC ACT NO. 9184 AND ITS RELEVANT ANNEXES

WHEREAS, Republic Act (RA) No. 9184 entitled "An Act Providing for the Modernization, Standardization and Regulation of the Procurement Activities of the Government Procurement and for Other Purposes," took effect on 26 January 2003;

WHEREAS, Section 63 of RA 9184 authorizes the Government Procurement Policy Board (GPPB) to formulate public procurement policies, rules and regulations, and amend, whenever necessary, its IRR;

WHEREAS, since the passage of RA 9184, the GPPB has issued two IRRs, namely: (a) IRR-A, and (b) the revised IRR, which took effect on 8 October 2003 and 2 September 2009, respectively;

WHEREAS, in a Memorandum from the Executive Secretary, dated 23 August 2006, the GPPB was authorized to formulate and promulgate rules and regulations, without need of Presidential approval, to carry out the provisions of RA 9184;

WHEREAS, the GPPB issued Resolution No. 06-2015, dated 30 January 2015, creating the Special Technical Working Group (IRR Review Committee), composed of the members of the Inter-Agency Technical Working Group (IATWG), for the review and revision of the 2009 Revised IRR of RA 9184;

WHEREAS, on 10 May 2016, during the 7th GPPB and 5th IATWG Joint Meeting, the GPPB issued Resolution No. 08-2016 confirming, adopting, and approving the 2016 Revised IRR of RA 9184 and the Consolidated Guidelines for the Alternative Methods of Procurement (Annex "H" of the 2016 Revised IRR of RA 9184); AScHCD

WHEREAS, on 10 June 2016, during the 8th GPPB and 6th IATWG Joint Meeting, the GPPB issued Resolution No. 12-2016 approving the inclusion of additional revisions to the 2016 Revised IRR of RA 9184 and its Annexes in accordance with the final legal review conducted by the GPPB-Technical Support Office (TSO);

WHEREAS, on 9 August 2016, during the 9th GPPB and 7th IATWG Joint Meeting, the GPPB-TSO presented to the Board for final approval the 2016 Revised IRR of RA 9184 and its relevant Annexes;

WHEREAS, the GPPB finally approved the 2016 Revised IRR of RA 9184 and its relevant Annexes, including the publication thereof in the Official Gazette or in a newspaper of general nationwide circulation and filing with the University of the Philippines Law Center: Provided, That no recommendation involving any substantial change is received by the GPPB-TSO on or before 16 August 2016;

NOW, THEREFORE, for and in consideration of the foregoing, WE, the Members of the GOVERNMENT PROCUREMENT POLICY BOARD, by virtue of the powers vested on US by law, hereby RESOLVE to confirm, adopt, and approve, as WE hereby confirm, adopt, and approve the 2016 Revised IRR of RA 9184 and its relevant Annexes, a copy of which is attached hereto as Annex "A", including its publication in the Official Gazette or a newspaper of general nationwide circulation, and filing with the University of the Philippines Law Center: Provided, That no recommendation involving any substantial change is received by the GPPB-TSO on or before 16 August 2016.

The 2016 Revised IRR of RA 9184 and its relevant Annexes shall take effect sixty (60) days after its publication in the Official Gazette or in a newspaper of general nationwide circulation and upon filing with the University of the Philippines Law Center.
