GPPB RESOLUTION NO. 012-16

ADDITIONAL PROVISIONS TO THE 2016 REVISED IMPLEMENTING RULES AND REGULATIONS (IRR) OF REPUBLIC ACT (RA) NO. 9184

WHEREAS, Republic Act (RA) No. 9184 entitled "An Act Providing for the Modernization, Standardization and Regulation of the Procurement Activities of the Government Procurement and for Other Purposes," took effect on 26 January 2003;

WHEREAS, Section 63 of RA 9184 authorizes the Government Procurement Policy Board (GPPB) to formulate public procurement policies, rules and regulations, and amend, whenever necessary, its IRR;

WHEREAS, the GPPB issued Resolution No. 06-2015, dated 30 January 2015, creating the Special Technical Working Group (IRR Review Committee), composed of the members of the Inter-Agency Technical Working Group (IATWG), for the review and revision of the 2009 Revised IRR of RA 9184;

WHEREAS, on 10 May 2016 during the 7th GPPB and 5th IATWG Joint Meetings, the GPPB issued Resolution No. 08-2016 confirming, adopting, and approving the 2016 Revised IRR of RA 9184 and the Consolidated Guidelines for the Alternative Methods of Procurement (Annex "H" of the 2016 Revised IRR of RA 9184);

WHEREAS, on 10 June 2016 during the 8th GPPB and 6th IATWG Joint Meetings, the GPPB-Technical Support Office presented additional proposed provisions to the 2016 Revised IRR of RA 9184 as a result of the final legal review conducted. The proposed provisions are detailed in Annex "A" hereof;

WHEREAS, the GPPB, as the agency mandated under RA 9184 to formulate and amend public procurement policies, rules and regulations, approved the inclusion of additional revisions to the 2016 Revised IRR of RA 9184, as approved last 10 May 2016; EcTCAD

NOW, THEREFORE, for and in consideration of the foregoing, WE, the Members of the GOVERNMENT PROCUREMENT POLICY BOARD, by virtue of the powers vested on US by law, hereby RESOLVE to confirm, adopt, and approve, as WE hereby confirm, adopt, and approve the inclusion of additional revisions to the 2016 Revised IRR of RA 9184, as enumerated in the attached Annex "A".

The 2016 Revised IRR of RA 9184 and its Annex "H", with the additional revisions, shall take effect sixty (60) days after its publication in the Official Gazette or in a newspaper of general nationwide circulation and upon filing with the University of the Philippines Law Center.
