CHED MEMORANDUM ORDER NO. 042-06
| SUBJECT | : | Amendments to CMO No. 14 s. 2005 entitled "The Guidelines and Procedures to be Observed by Higher Education Institutions (HEIs) Intending to Increase Tuition and Other School Fees, and Introduce New Fees" |
In accordance with the pertinent provisions of Batas Pambansa Blg. 232, Republic Act No. 7722, otherwise known as “Higher Education Act of 1994, Supreme Court decision in Lina vs. Carino (G.R. No. 100127, April 23, 1993) which reinforced and sustained the legal authority of the CHED (DECS in the said decision) to regulate tuition and other fees, and to issue guidelines for the imposition and collection thereof; and St. Joseph’s College vs. St. Joseph’s College Worker’s Association, G.R. No. 155609, July 18, 2005, which gave clarifications on how the incremental proceeds are to be disbursed and pursuant to Resolution No. 658-2006 of the 284th Commission en banc meeting. CHED Memorandum Order (CMO) No. 14, series of 2005 as amended is further amended as follows:
SECTION 1. Section 8 of CMO No. 14, s. 2005 as amended is further amended to read as follows:
"Section 8. Tuition and Other Fees. — The allowable increase in tuition and other fees in all levels should not be more than the prevailing national inflation rate.
Any increases in tuition and other fees in all levels to be made by private Higher Education Institutions (HEIs) shall be subject to consultation with stakeholders, in accordance with the processes set forth in this Order, and approval of the Commission on Higher Education through the CHED Regional Offices.
SECTION 2. Section 10 of CMO No. 14, s. 2005 as amended is hereby deleted and the subsequent provisions of CMO No. 14 are renumbered accordingly.
SECTION 3. All other provisions in CHED Memorandum No. 14, s. 2005, which are unaffected by this amendment, shall remain in full force and effect.
SECTION 4. All other issuances inconsistent herewith are repealed, modified or amended accordingly.
SECTION 5. This amendment shall take effect FIFTEEN (15) days after its publication in a newspaper of general circulation.
