SUBJECT : Revised Guidelines to CMO No. 13, s. 2005 "Policies, Standards and Guidelines for Maritime Education (2005 Revision)" 

 

In accordance with the pertinent provisions of Republic Act (RA) No. 7722 otherwise known as the "Higher Education Act of 1994," and by virtue of Resolution No. 126-2010 of the Commission en banc dated June 9, 2010, and for the purpose of complying with the requirements of STCW 1978 as amended, the following revised guidelines for maritime education are hereby adopted and promulgated by the Commission, thus:

Rationale

To revise the requirements of CMO No. 13, s. 2005 in the areas of Basic Safety Training and shipboard training to emphasize its importance to BS Marine Transportation (BSMT) and BS Marine Engineering (BSMarE) curricula.

Introduction

CMO No. 13, s. 2005, Article V. Curriculum and Sec. 23 (23.6, 23.7) defines the BSMT and BSMarE curricula and laboratory equipment, machinery, supplies, materials etc. respectively which are made an integral part of the Policies, Standards and Guidelines (PSG) for the HEIs offering maritime programs to adopt. The BSMT and BSMarE curricula and the Basic Safety Training facilities specifically included under Article V, Annex III and Section 26 (26.1 and 26.2) curriculum, functions and responsibilities of Shipboard Training Office and Shipboard Training Officer and other requirements of said standards to be complied with all Maritime Higher Education Institutions (Private and Public) having authority to operate maritime programs (i.e., BSMT, BSMarE). caHIAS

ARTICLE V

Curriculum

SECTION 14. Basic Safety Course.

14.5. The Basic Safety Courses may be taken at the accredited Training Centers by the Maritime Training Council (MTC) under a Memorandum of Agreement between the school and the Training Centers following the guidelines in Annex III.

SECTION 16. Shipboard Training.

16.4. Lecture on the proper filling of entries of the CHED approved Training Record Book (TRB) and issuance of the CHED TRB for the Bachelor of Science in Marine Transportation (BSMT) and Bachelor of Science in Marine Engineering (BSMarE) students must be on the 3rd year 1st semester or 2nd semester or before the student deployment for shipboard training.

16.5. The school is encouraged to specify in their Quality Standard System (QSS) a policy and procedure that the students of BSMT and BSMarE programs should enroll after the three-year academic requirements and before embarking in a one-year for BSMT and six-months for BSMarE shipboard training or depending on the schedule of its CHED approved curriculum and confirmation of embarkation on board a vessel. 16.6. After the supervised one-year shipboard training for BSMT and six-months shipboard training for BSMarE, cadets shall return back to the school where they are enrolled and present to the shipboard training officer its TRB indicating performance of their tasks during the actual operation of the ship and demonstrated competence in the skills required for assessment and endorsement to registrar to qualify for graduation.

16.7. Accomplished TRB must be returned back to the students after the assessment. Results of the assessment can be part of the record of the school.

16.8. In case of transfer of a student to another institution, the admitting higher education institution shall, upon receipt of the transfer credentials, request in writing for the complete school records or transcript of record of the student from the institution last attended. The latter shall forward the records directly to the former within thirty (30) days from receipt of the request as per provision on Manual of Regulation for Private Higher Education 2008.

SECTION 23. Facilities and Equipment.

23.10. All the necessary laboratory equipment except for the BSC requirements shall be made available in the school campus for easy access and to support the learning process of the students both in the practical and theoretical aspects.

SECTION 26. Shipboard Training Office.

SECTION 27. Sanction.

27.1 For violation of this Order, the Commission may impose such administrative sanction as it may deem appropriate under existing laws, particularly the Manual of Regulations for Private Schools, as well as B.P. 232, the "Education Act of 1982."

Effectivity Clause

SECTION 28. This CMO shall take effect starting SY 2010-2011 including existing maritime programs with permit status.

SECTION 29. An educational institutions applying to offer new maritime programs shall likewise comply with all the provisions of this CMO.

ANNEX

Annex III to CMO No. 13, s. 2005

GUIDELINES ON THE MEMORANDUM OF AGREEMENT (MOA) BETWEEN THE MARITIME INSTITUTION AND THE TRAINING CENTERS

1. These implementing guidelines are premised on the agreed framework of an open policy that:

1.1 Schools or Institutions with CHED authority to offer maritime programs may establish a Basic Safety Training program as an exemption from MTC moratorium.

1.2 Schools which will opt to continuously adopt the Memorandum of Agreement with MTC accredited Training Center shall comply with the "Safety Nets" defined in this CMO.

2. Self-governance and regulation among providers of Safety Training shall be the key element in effectively implementing the Competency-based Safety modules. CHED however, shall take cognizance of the issuance of authority supervision and monitoring in ensuring effectiveness of Basic Safety Course (BSC).

3. Ownership of Basic Safety facilities as required may either be full ownership or part ownership as provided by law.

4. The IRR in general shall cover the standards, processes and documentation that will govern BSC authority, conduct of training and certification.

5. The authority to offer Basic Safety Course shall be given once the applicant school complied with the MTC policies on the implementation of the Basic Safety Course as per MTC Resolution No. 2, s. 1998. All training centers shall be first accredited by MTC.

6. Approving BSC Memorandum of Agreement (MOA):

6.1 Applicant parties (Maritime Institutions and Training Centers) shall submit to CHED the MOA proposal with all the supporting documents for approval subject to CHED recommendation.

6.2 MOA mentioned in this rule must be valid. This MOA shall be subjected to CHED monitoring and evaluation for a period 2 years:

6.2.1 In case of transfer of MOA to another training center or additional training center/s same procedure shall apply.

6.2.2 Conduct of Basic Safety training must conform with the standards set by MTC.

6.2.3 The MOA may be terminated by either party by giving at least three (3) months notice, and CHED must be immediately informed of such termination.

6.2.4 In case that any party cease to exist for reasons of termination of accreditation, CHED must be informed immediately.

7. Monitoring and Verification. CHED shall have the power to monitor compliance to this guidelines. Maritime Assessors may visit the school BSC facilities for the purpose of verification in case of any complaints.

8. The standard checklist of Maritime Training Council (MTC) for basis of issuance of authority to offer Basic Safety Course shall be adopted (attachment A).

9. The CHED standard form and requirement for a Memorandum of Agreement between school and training center shall be strictly followed.

10. The CHED prescribed form — MEUF-CC-1 shall be used by maritime institutions as standard form in issuance of "Certificate of Completion".

11. Issuance of Authority to offer the Basic Safety Courses (BSC) shall be governed by rules and regulations of MTC and engaged in MOA with Training Centers shall be categorized as follows:

11.1 Both theoretical and practicum shall be conducted in training center and the approval of MOA between the school and training center shall be governed by this CMO.

11.2 Notwithstanding anything contain in this section, contact hours and student laboratory equipment ratio must be implemented.

12. School must have a MOA with training center located within the neighboring regions where the school is located.

15. MOA shall be suspended or withdrawn on the occurrence of the following:

15.1 Non submission of annual reports as per number 10

15.2 Violation of the Scope of Accreditation

15.3 Any violation of any provision of this guidelines and the MOA shall be ground for cancellation or revocation of accreditation
