DICT MEMORANDUM ORDER NO. 03-18
AMENDING CERTAIN PROVISIONS OF MEMORANDUM ORDER NO. (MO) 001, SERIES OF 2018, AS AMENDED BY MO 2, S. 2018, OR THE POLICY GUIDELINES FOR THE ENTRY OF A NEW MAJOR PLAYER IN THE PUBLIC TELECOMMUNICATIONS MARKET
In the exigency of service and to ensure the successful entry of a New Major Player (NMP) in the public telecommunications market, consistent with Administrative Order No. (AO) 11, series of 2018, dated 06 April 2018 issued by President Rodrigo R. Duterte, there is a need to further amend certain provisions of the DICT MO 001, s. 2018 dated 08 January 2018, as amended by MO 002, s. 2018.
SECTION 1. Section 1 (a) and (c) of DICT MO 001, s. 2018 is hereby amended to read as follows: HTcADC
"SECTION 1. Qualifications. — Participant shall have the following minimum qualifications:
a. Legal Qualification: Holder of Congressional Franchise that is not a related party to any Dominant Telecommunications Player and has no uncontested outstanding liabilities as of 01 October 2018, i.e., Supervision and Regulation Fees (SRF), Spectrum User Fees (SUF), including penalties, surcharges and interests.

c. Technical Capability: Shall have experience in the provisioning, delivery and operations of telecommunications services for the last ten (10) years on a national scale."
SECTION 2. Section 2 of DICT MO 001, s. 2018 is hereby amended to read as follows: CAIHTE
"SECTION 2. Criteria for Selection and Timeframe. — The criteria to be used for the selection of the NMP shall be the highest committed level of service, i.e., national population coverage and minimum average broadband speed, and highest committed capital and operational expenditures for the first five (5) years shall be the NMP, subject to a qualifying point system."
SECTION 3. Repeal Clause. — All other orders, issuances, or parts thereof, which are inconsistent with any of the provisions herein, are hereby repealed or modified accordingly.
SECTION 4. Saving and Separability Clause. — If any provision of this Order is declared invalid, the other provisions not affected thereby shall remain valid and subsisting. It is also understood that all other provisions under DICT MO 001, s. 2018 and MO 002, s. 2018 remain in force.
SECTION 5. Effectivity Clause. — This Order shall take effect immediately.
