Please take notice that the Court, First Division, issued a Resolution datedJune 27, 2018which reads as follows: aScITE
"G.R. No. 235009 (People of the Philippines v. Rodrigo Subaba y Roquero). — After review of the records, the Court resolves to DISMISS the appeal for failure to sufficiently show that the Court of Appeals committed any reversible error in upholding the conviction of accused-appellant Rodrigo Subaba y Roquero for violation of Article 266-A paragraph 1 (a) of the Revised Penal Code, as amended.
WHEREFORE, the Court ADOPTS the findings of fact and conclusions of law in the Decision dated July 20, 2017 of the Court of Appeals in CA-G.R. CR-HC No. 08293 and AFFIRMS said Decision finding accused-appellant Rodrigo Subaba y Roquero GUILTY beyond reasonable doubt of violation of Article 266-A, paragraph 1 (a) of the Revised Penal Code, as amended by Republic Act No. 8353, sentencing him to suffer the penalty of reclusion perpetua with MODIFICATIONS that accused-appellant should pay private complainant P75,000.00 as civil indemnity, P75,000.00 as moral damages, and P75,000.00 exemplary damages. The Office of the Solicitor General's manifestation, pursuant to the Resolution dated January 19, 2018, stating that it is dispensing with the filing of a supplemental brief to expedite the resolution of the case and to avoid repetition of arguments and adopting the Appellee's Brief dated January 9, 2017 filed before the Court of Appeals as its supplemental brief; and the accused-appellant's manifestation (in lieu of supplemental brief), pursuant to the Resolution dated January 19, 2018, stating that he will no longer file a supplemental brief since no new issues material to the case which were not elaborated upon in the brief for the accused-appellant filed before the Court of Appeals were discovered, are both NOTED.
