NOTICE
Sirs/Mesdames :
Please take notice that the Court, Third Division, issued a Resolution dated August 2, 2017, which reads as follows:
"G.R. No. 214469 (People of the Philippines v. Roderick Galliguez y Navarro). — The records of this case were elevated to this Court pursuant to the Resolution dated June 11, 2014 of the Court of Appeals (CA) which gave due course to the accused-appellant Roderick Galliguez y Navarro's Notice of Appeal.
On December 3, 2014, this Court issued a Resolution wherein it notified both parties to file their respective supplemental briefs. In lieu, however, thereof, the Public Attorney's Office filed a Manifestation 1 wherein it stated that it will be adopting the arguments it had previously proffered in the brief it submitted with the CA. Also, the Office of the Solicitor General filed its Manifestation 2 wherein it submitted that considering no new matters were raised by accused-appellant, it will no longer file a supplemental brief.
After a perusal of the records of the case, this Court resolves to dismiss the appeal for failure of accused-appellant to sufficiently show any reversible error in the assailed Decision 3 dated April 10, 2014 of the CA which would warrant the exercise of this Court's appellate jurisdiction.
In view of current jurisprudence, however, this Court modifies the award of damages by increasing the amount of moral damages to P75,000 and exemplary damages to P75,000. 4
In addition, this Court also imposes on all the monetary awards for damages interest at the legal rate of 6% per annum from the date of finality of this Decision until fully paid. 5
WHEREFORE, the appeal is DISMISSED. The Court of Appeals' Decision dated April 10, 2014 in CA-G.R. CR-HC No. 05999 is AFFIRMED, subject to the following MODIFICATIONS:
1.) The award of P50,000 as moral damages is increased to P75,000; and
2.) The award of P30,000 as exemplary damages is increased to P75,000.
In addition, all monetary awards for damages shall earn interest at the legal rate of 6% per annum from date of finality of this Decision until fully paid.
