PRESIDENTIAL DECREE NO. 1093
PROVIDING FOR AN UPDATED RECORDING AND KEEPING OF MINING INSTRUMENTS AND DOCUMENTS
WHEREAS, it has been observed that confusion arises in the implementation of Section 1 of Presidential Decree No. 513; and
WHEREAS, in order to update the proper recording and keeping of mining instruments and documents registered under Commonwealth Act No. 137, as amended, and other previous mining laws, there is a need to amend Sections 1 and 2 of Presidential Decree No. 513; casia
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by the Constitution, do hereby order and decree:
SECTION 1. Sections 1 and 2 of Presidential Decree No. 513 are hereby amended to read, as follows:
"Sec. 1. The Register of Deeds as ex-officio mining recorder under Commonwealth Act No. 137, as amended, shall cease to act as such mining recorder for the registration of all mining instruments or documents pertaining or relating to or affecting mining claims located or mining rights acquired prior to May 18, 1974 under the aforesaid Act. He shall immediately turn over to the Mines Regional Office concerned all said mining documents and instruments which are in his custody and possession. For this purpose proper arrangements shall be made between the Register of Deeds and the Mines Regional Office concerned in order to effect a smooth transfer of said mining instruments and documents.
Mining instruments and documents required or allowed to be registered with the mining recorder concerned pursuant to Commonwealth Act No. 137, as amended, prior to May 18, 1974, and instruments and documents required to be registered under Presidential Decree No. 463 shall be recorded with the Mines Regional Office or such other persons that may be designated or appointed by the Director of Mines. The Director of Mines shall be responsible for the proper recording of such documents and instruments and shall issue such forms, rules and regulations to implement this Decree."
SECTION 2. Any provision of existing laws, decrees, orders or regulations inconsistent herewith is hereby repealed or amended accordingly.
SECTION 3. This Decree shall take effect immediately.
