ACT NO. 1399
AN ACT AMENDING SECTION FIVE OF ACT NUMBERED SIX HUNDRED AND TWENTY-FOUR, AS AMENDED, BY PROVIDING FOR THE PAYMENT OF FEES FOR RECORDING ALL DOCUMENTS AND INSTRUMENTS IN WRITING, OF WHATEVER CHARACTER, WHICH AFFECT THE POSSESSION OF MINING CLAIMS
SECTION 1. Section five of Act Numbered Six hundred and twenty-four, entitled "An Act prescribing regulations governing the location and manner of recording mining claims, and the amount of work necessary to hold possession of a mining claim, under the provisions of the Act of Congress approved July first, nineteen hundred and two, entitled 'An Act temporarily to provide for the administration of the affairs of civil government in the Philippine Islands, and for other purposes,'" as amended by Act Numbered Eight hundred and fifty-nine, is hereby further amended so as to read as follows:
"SEC. 5. There shall be paid to the provincial treasurer, or in the Moro Province to the district treasurer of the proper district, a fee of two Philippine pesos for each declaration of location of a mining claim and for each affidavit accompanying such declaration, and for each document or instrument in writing, of whatever character or nature, alienating, mortgaging, leasing, or otherwise affecting the possession of mining claims or any right or title, thereto or interest therein, filed for record, and on the presentation of the receipt of the provincial or district treasurer the said declaration, affidavit, or other document or instrument in writing shall be recorded by the mining recorder, providing all requirements of the law before recording shall have been complied with. These fees shall be accounted for as other collections of the officers receiving them, and deposited for the credit of the proper province or district, in accordance with section six of Act Numbered Six hundred and twenty-four."
SECTION 2. The public good requiring the speedy enactment of this bill, the passage of the same is hereby expedited in accordance with section two of "An Act prescribing the order of procedure by the Commission in the enactment of laws," passed September twenty-sixth, nineteen hundred.
SECTION 3. This Act shall take effect on its passage.
