BI OPERATIONS ORDER NO. SBM-2014-047

SUPPLEMENTAL GUIDELINES IN THE ENFORCEMENT OF DEROGATORY ORDERS IN THE PORTS OF EXIT

WHEREAS, Operations Order No. SBM-2014-002 on Enforcement of Derogatory Orders in the Ports of Exit provides:

2. WATCHLIST ORDER (WLO)

Unless otherwise provided in the Order issued by the BI, any person whose name is in the Watchlist shall be denied departure.

If the inclusion of his/her name in the Watchlist is due to a pending deportation case, the passport of the subject shall be confiscated and turned-over to the Legal Division. . .

WHEREAS, there has been instances when a deportable foreigner, upon interception at the airport, should have been turned-over to the BI Warden's Facility (BIWF) because poses a clear and present danger to public safety and national interest;

NOW, THEREFORE, pursuant to CA 613, Sec. 3 granting the rule-making power of the Commissioner, the following shall be observed:

SECTION 1. Turn-over of Dangerous Deportable Foreigners. – In case a deportable foreigner poses a clear and present danger to public safety and national interest; the Legal Division shall include in the Watchlist Order against the subject foreigner the remarks that the BMSU 1 shall turn over the foreigner to the BIWF upon interception at the ports of exit.

EXAMPLE: The ICTS is hereby directed to include the name El Jay L. Pground in the Watchlist with remarks, "charged: undesirability; engages in access device crime; for turnover to BIWF upon interception"

SECTION 2. Effectivity. — This Operations Order shall take effect immediately. CHIEDS

Furnish copies of this Operations Order to the Office of the National Administrative Register (ONAR), U.P. Law Center, U.P. Diliman, Quezon City.
