BI OPERATIONS ORDER NO. SBM-2014-002
ENFORCEMENT OF DEROGATORY ORDERS IN PORTS OF EXIT
Pursuant to Section 3 of Commonwealth Act No. 613 (Philippine Immigration Act of 1940), as amended, and in order to systematically enforce the Bureau of Immigration (BI)'s derogatory records against any person in all Philippine international ports of exit, the following are hereby ordered:
1. Hold Departure Order (HDO)
Unless other provided in the Order issued by the BI, any person whose name is in the Hold Departure List shall be denied departure and proceeded as follows:
a. If the person is a subject of a warrant of arrest issued to him/her by a Court, subject shall be turned-over to the Philippine National Police (PNP) or National Bureau of Investigation (NBI).
b. If the person is a subject of a Bail Order issued to him/her by the Commissioner relative to a pending deportation case, the passport of the subject shall be confiscated and turned-over to the Legal Division.
In both cases, the primary Immigration Officer shall prepare an Incident Report detailing the subject's failed attempt to depart, duly noted by the Immigration Supervisor On-Duty, for submission to the Office of the Commissioner within twenty-four (24) hours therefrom. DTEAHI
2. Watchlist Order (WLO)
Unless other provided in the Order issued by the BI, any person whose name is in the Watchlist shall be denied departure.
If the inclusion of his/her name in the Watchlist is due to a pending deportation case, the passport of the subject shall be confiscated and turned-over to the Legal Division.
In all cases, the primary Immigration Officer shall prepare an Incident Report detailing the subject's failed attempt to depart, duly noted by the Immigration Supervisor On-Duty, for submission to the Office of the Commissioner within twenty-four (24) hours therefrom.
3. Blacklist Order (BLO)
With the exception of the Blacklist issued due to a deportation order, a foreign national whose name is in the Blacklist shall NOT be denied departure provided that his/her name is not in the Hold Departure List, Watchlist or Alert List.
In this case, the primary Immigration Officer shall prepare an Incident Report, together with a photocopy of the foreign national's passport, for submission to the Office of the Commissioner within twenty-four (24) hours from actual departure indicating the following: (a) his/her personal circumstances; (b) BLO Reference Number; and (c) the name of the Immigration Officer who last cleared him/her for admission.
In the excepted case, the foreign national and his passport shall be referred to the AOD-Intelligence Unit who shall eventually turn-over the subject national and his passport to the Legal Division for implementation of the deportation order.
4. Alert List Order (ALO)
Unless other provided in the Order issued by the BI, any person whose name is in the Alert List shall be denied departure and proceeded as follows:
a. If the person is a subject of a warrant of arrest issued to him/her by a Court, subject shall be turned-over to the Philippine National Police (PNP) or National Bureau of Investigation (NBI). TIaCcD
b. If the inclusion of his/her name in the list is due to reasons other than a Warrant of Arrest, the passport of the subject shall be confiscated and turned-over to the Legal Division.
In both cases, the primary Immigration Officer shall prepare an Incident Report detailing the subject's failed attempt to depart, duly noted by the Immigration Supervisor On-Duty, for submission to the Office of the Commissioner within twenty-four (24) hours therefrom.
All circular, memoranda, orders and other issuances inconsistent herewith are hereby repealed, amended and/or modified accordingly.
This Order takes effect immediately upon approval.
