BI OPERATIONS ORDER NO. RAGE-2016-007
RULES ON BI CCTV-CAPTURED INCIDENTS
WHEREAS, in view of ensuring security of the public and monitoring of activities of the Bureau of Immigration (BI) employees as well as other concerned personnel at international airports, BI Main Office, BI Warden Facility (BIWF), and other future covered sites, the Bureau shall establish efficient regulations in the implementation of CCTV cameras and surveillance of significant events thereof;
WHEREAS, there is a need to determine level of information and classify incidents that transpire at areas covered by BI CCTV cameras in order to provide quality reports and references;
NOW THEREFORE, pursuant to the rule-making authority of the Immigration Commissioner under C.A. 613, Sec. 3, the following shall be observed:
SECTION 1. Classification of Incidents. — BI-CCTV captured incidents shall be classified as follows:
a. Tier 1 or "Yellow" incidents are day-to-day/routine activities encoded at 15-minute intervals and may be considered reference for significant events;
b. Tier 2 or "Orange" incidents refers to noteworthy events requiring the BINOC Chief and/or Assistant Chief's review; and
c. Tier 3 or "Red" incidents are observed activities which requires immediate attention/action and are considered threats and/or risks to national security, public safety, public health, public morals or public interest.
Significant events classified as Tier 2 (Orange) and Tier 3 (Red) are listed under Annex "A" of this Order.
SECTION 2. Duties of Bureau of Immigration National Operations Center (BINOC). Data Storage. — BINOC personnel shall:
2.1 Submit to the Office of the Commissioner all daily journals of events under Section 1;
2.2 Archive all daily journals under Section 2.1;
2.3 Review captured Tier 2 or ORANGE incidents the observed incident and submit detailed written report to BINOC Chief and/or Assistant Chief for further checking and assessment.
2.4 Escalate confirmed to be a Tier 2 or ORANGE incidents to the Port of Operations Division (POD) Chief and copy furnish the Office of the Commissioner.
2.5 Report in writing all Tier 3 or RED events to the BINOC Chief or Assistant Chief who on the other hand will immediately report the case to the Honorable Commissioner and/or authorized representative for proper handling; and
2.6 Secure screenshots and/videos of the incident in support and reference to the submitted report.
2.7 Include observed incident in the weekly and monthly report.
SECTION 3. Disciplinary Actions. — BI personnel under Section 1 (b) or (c) shall be reported in writing within 72 hours to the Commissioner and the Board of Discipline (BOD).
SECTION 4. Applicability. — All other immigration restrictions and prohibitions not specifically covered by this Order shall apply in a suppletory manner.
This Operations Order takes effect immediately.

ANNEX A
Classification of CCTV Captured Incidents
I. Tier 2 or Orange Incidents
A. International Airports
1. BI employees not wearing complete and existing prescribed uniform or acceptable attire
2. BI employees not wearing properly the existing prescribed/acceptable uniform/attire
3. BI employees who use mobile phones and "other similar devices" during their tour of duty
4. Immigration Officers who fail to require passengers to remove their dark glasses, caps and/or hats during the conduct of primary inspection
5. Immigration officers who sleep inside the counter with or without flight operation
6. Immigration officers who play computer games inside the immigration counter with or without flight operation
7. Immigration Officers who watch movies or listen to music while inside the counter with or without flight operation
8. Immigration Officers who read books, magazines and papers other than those related to Office issuances, inside the immigration counter with or without flight operation
9. Immigration Officers who failed to check (failed to encode and stamp) the passport of the passenger
10. Immigration Officers who failed to stamp or encode the passport of the passenger.
11. Immigration Officers who eat and drink inside the counter with or without flight operation. Drinking water is allowed as long as it is placed in a sealed water container. The Officer has to ensure that said water container will not obstruct the working area of the immigration counter.
12. Immigration Officers who failed to display or properly placed their name tags/cards inside the counter.
13. Immigration Officers who uses the immigration computer outside of its purpose (Google, Internet, Facebook, Youtube, etc.)
14. Immigration employees taking pictures with some celebrity or high profile passengers while on duty-post
15. Immigration officers who refuses to discharge his official function or completing his primary function (i.e., Immigration Officers supposedly on-duty but not seen on post for more than 30 minutes; the passenger approached the Immigration Officer for arrival/departure formalities but the Officer refuses to assist the passenger etc.)
16. Occurrence of computer downtime or power interruption for less than 10 minutes
17. BI employees or personnel, except for the Border Control Cluster and/or any authorized representative of the Commissioner, who are not covered by a Travel Order or Personnel Order for a specified purpose at or in the premises of any international port of entry and exit.
18. Port Operations Divisions (POD) officers, staff including, but not limited to Immigration Officers, Supervisors, TCEU officers and other immigration personnel staying in the premises of any international port of entry and exit after their tour of duty.
B. Holding Facility
1. BI employees who are not in prescribed complete uniform
2. BI employees who are not wearing properly the prescribed complete uniform
3. Detainees and visitors not following the prescribed dress code or dressed in unacceptable manner
4. Detainees who use their mobile phones, computers and "other similar devices" beyond the prescribed area and allowed time. The allowable period and extension, if necessary, shall be determined by the Acting Chief of the holding facility and shall be approved by the Honorable Commissioner.
5. Presence of detainees and/or visitors beyond the prescribed visiting area
6. Presence of visitors beyond visiting hours except counsels and concerned embassy officials. The existing visitation schedule prescribed is at 1000H-1200H and 1300H-1700H. Tuesdays and Thursdays are regular visitation while Saturdays are considered family day hence children are allowed to visit.
7. Conjugal visits beyond the prescribed period which is every Sunday.
8. Alcoholic beverages and prohibited drugs seen inside the holding facility except medicines prescribed by BI Medical Officer or detainee's attending physician.
9. Persons visibly under the influence of drugs or alcohol
10. BI employees sleeping during their duty
11. Mingling of male and female detainees without affiliation (i.e., husband & wife/boyfriend & girlfriend) as verified with the BI-WFPU personnel.
12. Public display of affection including but not limited to cuddling, embracing and kissing to the point of offending other persons inside the facility
13. Indecent, immoral or lascivious acts by himself or allowing himself to be the subject of said acts
14. Unruly conduct/behavior and flagrant disregard of discipline and good order inside the facility
15. Littering and failure to maintain cleanliness and orderliness in his surroundings
16. Damaging any government property or equipment including writing, defacing or drawing on walls, floors or any furniture or equipment
17. Engaging in gambling or any game of chance that involves betting and/or money.
18. Detention personnel opening the confinement area alone
C. Main Office
1. BI employees not wearing complete and prescribed uniform or acceptable attire
2. BI employees not wearing properly the prescribed/acceptable uniform/attire
3. BI employees sleeping during the hours of work
4. BI employees accepting money or gifts from clients outside of its official transactions
5. BI employees who play computer games inside the immigration counter
6. BI employees loafing, loitering and idling during office work
7. BI frontline employees who eat and drink inside the office counter while on-duty.
8. BI employees smoking inside the BI prohibited areas
9. Public display of affection including but not limited to cuddling, embracing and kissing to the point of offending other persons inside the facility
10. Indecent, immoral or lascivious acts by himself or allowing himself to be the subject of said acts
11. Unauthorized facilitation and illegal transactions with clients.
12. Dealing with fixers and/or banned liaisons/travel agents and or representatives from travel agencies, schools or law offices
II. Tier 3 or Red Incidents
A. International Airports
1. Immigration Officers fighting with fellow employees and/or with passengers causing commotion or disturbance
2. BI official and employee who is facilitating/assisting the departure or arrival of any passenger, either personally, by phone call or by text message (SMS), intended to expedite clearance or unduly influence the decision of POD personnel in violation of existing immigration arrival and departure formalities.
3. Incidents of power interruption or computer downtime for more than 10 minutes
4. Incidents of fire, earthquake, bomb threat, explosion and other disasters
5. Immigration Officers who accept money from passenger(s) not included in the official transaction
6. Immigration Officers who stamped passports outside the immigration counter except special flights and upon instruction from the Immigration Supervisor
7. Presence of excluded passengers beyond the holding/prescribed area;
8. Unruly conduct of passenger and flagrant disregard of order and discipline during the primary and secondary inspection
9. Unauthorized facilitation of the passenger in the BI arrival and departure area
10. Non-compliance with the order, directive and instruction of the Commissioner
B. Holding Facility
1. Commotions, noise barrage, riots and other disturbances in the facility
2. Fighting, causing any disturbance or participating therein and/or inciting others to cause disturbance or riot.
3. Incidents of fire, earthquake, bomb threat, explosion and other disasters
4. Incidents of power interruption or computer downtime for more than 10 minutes
5. Release of detainees from confinement without prior notice to BINOC Monitoring
6. Helping, aiding or abetting others to escape
7. Escaping, attempting or planning to escape from the Detention Center or from any guard
8. Taking money or gifts from the detainees or visitors
C. Main Office
1. Commotions, noise barrage, riots, strikes and other disturbances in the office
2. Fighting, causing any disturbance or participating therein and/or agitating others to cause disturbance or riot
3. Incidents of fire, earthquake, bomb threat, explosion and other disasters
4. Incidents of power interruption or computer downtime for more than 10 minutes
5. Incidents of theft and robbery
