GAB RESOLUTION NO. 12-18
RULES AND REGULATIONS FOR PROFESSIONAL MOTORIZED WATER SPORTS COMPETITIONS HELD IN THE PHILIPPINES
QUOTED hereunder is the Resolution adopted by the Board during its 5th Regular Meeting for CY 2018 held on July 3, 2018, to wit:
WHEREAS, the Games and Amusements Board (GAB) encourages and gives full support to new professional sports or games in the country in furtherance of the constitutional policy of the State to promote physical education and to encourage overall sport and game programs, league competitions, including training for international competitions, as well as to foster self-discipline, teamwork and excellence for the development of health and alert citizenry (Art. XIV, Sec. 19-1, Philippine Constitution); IDaEHC
WHEREAS, the GAB recognizes Motorized Water Sports Competition as a professional sport or game under its jurisdiction;
WHEREAS, the GAB is mandated under Presidential Decree No. 871 to regulate and supervise the operation and conduct of professional sports or games, as well as persons connected therein;
WHEREAS, GAB ensures the integrity of the sports and games provides ample protection to all concerned at all times;
WHEREAS, pursuant to Presidential Decree No. 871, the GAB is empowered to prescribe additional rules and regulations that will govern the operation and conduct of professional sports/games in the Philippines;
NOW, THEREFORE, be it RESOLVED, to adopt the following RULES AND REGULATIONS FOR PROFESSIONAL MOTORIZED WATER SPORTS COMPETITIONS HELD IN THE PHILIPPINES, to wit:
SECTION 1. Coverage. —These rules and regulations shall apply to all Professional Motor-Powered Water Racing Competitions conducted through the use of motorized high-speed water vehicles, such as but not limited to, boat or jetski, operated or driven by professional riders who race against each other through a water course, or under time trial;or compete by performing routines/manoeuvres for judging and scoring. Professional motorized water sports riders are those participants in the motor-powered or motorized water sports competitions, who are paid sums or money and other forms of compensation as regular salary or prize money. Promoters or organizers of professional motorized water racing competitions shall provide for professional category or professional motor-powered water racing riders which shall not include the general public, or casual enthusiasts. Only professional motorized water sports riders who belong to top-professional, elite, expert, or top level categories shall be required to obtain license from GAB.
SECTION 2. Licensing Requirements. —
2.1 All persons, entities or associations connected with, engaged or participating in the conduct or operation of Professional Motorized Water Sports shall comply with the following licensing requirements:
a) Duly accomplished application form
b) Two (2) copies 2 X 2 colored ID picture (white background) or personal appearance with GAB Information Technology (IT) Section for taking of photos
c) Photocopy of government issued ID
d) Affidavit of Parental Consent (For Minors)
e) For Promoter/s Only: Income Tax Return (In Case of Individual Public Officer/Employee) or Statement of Assets &Liabilities (In Case of Individual Private Officer/Employee) or Security and Exchange Commission or SEC Registration and Financial Statements i.e., Statement of Net Income or Balance Sheet (In Case of Corporations) EDCcaS
f) For Riders Only: Certificate of Membership or Letter of Endorsement from, Accredited Association/Club or Professional License Card Issued Abroad (For New Applicants) —
g) For Athletes Only: Drug Test for Methaphetamine (a.k.a. as "Shabu") and Tetrahydrocannabinol (Marijuana)
2.2 Foreign Riders with Professional License issued abroad by Recognized International Motorized Water Racing/Sports Associations, though exempt from drug testing, still have to secure appropriate GAB license.
2.3 Fees. The following fees shall be imposed:

2.4 Validity. The license of a Professional Motor-Powered Water Race Rider shall be valid for one (1) year which must be renewed on or before his/her birthday.
All other licenses shall be valid for two (2) years, subject to the payment of license fees equivalent to two (2) years, which must be renewed on or before the birthday of the licensee. ISHaCD
A penalty of fifty percent (50%) of the basic license fee shall be imposed on late renewals.
SECTION 3. Permit Requirement. —No Professional Motorized Water Sports Competition or Tournament shall be held, without permit duly issued by the Games and Amusements Board.
The promoter of such a Professional Motorized Water Sports Competition or tournament shall file an application for the issuance of permit to the GAB at least ten (10) days before the date of the game, competition or tournament and shall pay the following:

SECTION 4. Government Share in Income. —Any person, entity, or association conducting a Professional Motor-Powered Water Sports Competition or Tournament shall set aside and remit to the Games and Amusements Board three (3) percent (3%) of the gross tournament ticket sales receipts and income from television, radio or motion picture rights.
A deposit of at least fifty percent (50%) of the estimated three percent (3%) share of GAB shall be remitted to the GAB prior to the day of the Tournament. The remainder shall be paid not later than fifteen (15) days from the date of such game or competition. cDTACE
SECTION 5. All other relevant provisions of Presidential Decree (P.D.) No. 871 and other policies, rules and regulations of the Games and Amusements Board in professional sports and games shall be applicable to the requirements in the conduct of professional motor-powered water race competitions in the Philippines.
