CESB RESOLUTION NO. 798-09
REVISED RULES AND PROCEDURES ON ORIGINAL AND PROMOTIONAL APPOINTMENT TO CAREER EXECUTIVE SERVICE (CES) RANKS
WHEREAS, Presidential Decree No. 1, dated September 24, 1972, created the Career Executive Service Board (CESB) to serve as the governing body of the Career Executive Service (CES) and mandated it to promulgate rules, standards and procedures on selection, classification, compensation and career development of members of the Career Executive Service; SIDTCa
WHEREAS, the same law provides that members of the Career Executive Service (CES) shall be classified according to rank based on broad levels of responsibility and on personal qualifications and demonstrated competence;
WHEREAS, on February 21, 2008, the Board passed CESB Resolution No. 718 entitled "Rules and Procedures on Original and Promotional Appointment to Career Executive Service (CES) Ranks" supplanting CESB Resolution No. 453 dated September 10, 2002 where the concept of the equivalency of rank and position was restored for purposes of original appointment and/or adjustment in CES rank and the promotion in CES rank without need of getting promoted to a higher position provided under CESB Resolution No. 453 s. 2002 was continued;
WHEREAS, the above-said guidelines admit of several gaps in the interpretation and implementation thereof;
WHEREAS, there is a need to address these policy gaps to provide relief to its interpretation and implementation;
WHEREFORE, based on the foregoing premises considered, the Board RESOLVES, as it is hereby RESOLVED, to adopt the Revised Rules and Procedures on Original Promotional Appointment to Career Executive Service (CES) Ranks:
ARTICLE I
Original Appointment to a Career Executive Service (CES) Rank
SECTION 1. The Career Executive Service (CES) Ranking Structure. — There are six (6) ranks in the Career Executive Service (CES) Ranking Structure, to wit:

In the above ranking structure, Career Executive Service Officer (CESO) I shall be the highest rank with an equivalent salary grade of 30, while Career Executive Service Officer (CESO) VI shall be the lowest rank with an equivalent salary grade of 25.
SECTION 2. Membership in the CES. — Upon inclusion of his/her name in the roster of CES eligibles after the conferment of CES eligibility and compliance with the other requirements prescribed by the Career Executive Service Board, herein referred to as the Board, a CES eligible appointed to any CES position and appointed by the President to a CES rank upon the recommendation of the Board becomes a member of the CES.
SECTION 3. Original Appointment to a CES Rank. — Original appointment to a CES rank shall be made by the President from a list of CES eligibles recommended by the Board. A CES eligible appointed to a CES position may qualify for original appointment to a CES rank based on the salary grade corresponding to the CES position to which he/she occupies. aAEIHC
SECTION 4. Requirements for Original Appointment to a CES Rank. — The Board shall recommend a CES eligible for original appointment to a CES rank upon compliance with the following basic requirements:
a. Residency Requirement. A CES eligible must be an incumbent of a CES position for at least one (1) year before he/she may be recommended for appointment to a CES rank.
b. Performance Rating. A CES eligible must have obtained a Career Executive Service Performance Evaluation System (CESPES) rating of at least "Very Satisfactory" in the CES position he/she is currently occupying during the above required one-year incumbency.
c. Training Requirements. A CES eligible must comply with the following training requirements:

ARTICLE II
Promotional Appointment to a Career Executive Service (CES) Rank
SECTION 1. Promotional Appointment to a CES Rank. — Promotional Appointment of a CESO to a higher CES rank shall be made by the President upon recommendation of the Board. There are two (2) classes of promotional appointment to a CES rank, namely:
a. Adjustment in CES Rank — refers to the appointment of a CESO by the President to a CES rank, which is equivalent to the higher CES position to which he/she has been appointed to, upon the recommendation of the Board; and,
b. Promotion in CES Rank — refers to the appointment of a CESO by the President to the next higher CES rank, even without getting promoted to a higher CES position, upon the recommendation of the Board.
SECTION 2. Requirements for Adjustment in CES Rank. — The Board shall recommend to the President the adjustment in CES rank of a CESO equivalent to the higher CES position to which he/she has been appointed to, upon compliance with the following basic requirements:
a. Residency Requirement. A CESO must have at least one (1) year incumbency in his/her present CES position before he/she can be recommended for an adjustment in CES rank.
b. Performance Rating. A CESO must have obtained a CESPES rating of at least "Very Satisfactory" in the CES position he/she is currently occupying during the above-required one-year incumbency.
c. Training Requirements. A CESO shall be required to comply with the training requirements commensurate to the CES rank to which he/she is applying for as provided under paragraph c, Section 4, Article I of this Resolution.
The requirement to attend the Executive Leadership Program (ELP) or any of its courses for purposes of appointment to a CES rank shall not be applied retroactively. Hence, a CESO, who obtained his/her CES rank at the time when attendance to the ELP was not yet required, need only to take the training requirements prescribed in the next higher CES rank.
SECTION 3. Requirements for Promotion in CES Rank. — The Board shall recommend to the President the promotion to the next higher CES rank of a CESO, even without getting promoted to a higher CES position, upon compliance with the following basic requirements:
a. Residency Requirement. A CESO must have at least three (3) years residency in his/her present CES rank.
b. Performance Rating. A CESO must have obtained a CESPES rating of at least "Very Satisfactory" for every year of residency in the CES rank. LLphil
An Outstanding performance rating received by a CESO in a particular year shall be equivalent to two (2) years of experience in the CES rank.
A CESO who receives an Outstanding and a Very Satisfactory performance rating shall be considered to have met the three (3) years of residency in the CES rank and may be recommended by the Board for promotion in CES rank. The computation of either an Outstanding or a Very Satisfactory performance rating shall be cumulative in nature.
An Unsatisfactory performance rating received by a CESO before he/she could complete the three (3) Very Satisfactory or the Outstanding/Very Satisfactory CESPES requirements referred to in the preceding paragraphs shall obliterate his/her previously obtained Outstanding and/or Very Satisfactory ratings. Hence, the CESO concerned shall be required to start once more accumulating Outstanding and/or Very Satisfactory ratings pursuant to the rules provided in the preceding paragraphs of this section before he/she can be recommended by the Board for promotion to a higher CES rank. c. Training Requirements. A CESO shall be required to comply with the same training requirements provided under paragraph c, Section 4, Article I of this Resolution.

SECTION 4. Performance Validation Process for Promotional Appointment to a CES Rank. — Before a CESO shall be recommended by the Board for promotion or adjustment in CES Rank, he/she shall be subjected to a performance validation process to determine whether there are major negative feedback/s on his/her on-the-job performance, leadership capacity, managerial competence and integrity.
The Performance Validation Report submitted by the Validator shall contain any of the following recommendations:
a.) Recommended for promotion/adjustment in a CES Rank. A Validator may recommend the promotion/adjustment of the CES rank in case the CESO possesses the necessary competencies required for the CES rank he/she is applying for, provided there are no major negative feedback on the CESO's on-the-job performance, leadership capacity, managerial competence and integrity.
b.) Not recommended for promotion/adjustment in a CES Rank. A Validator may not recommend a CESO for promotion/adjustment in a CES rank in case he/she does not possess the necessary competencies for the CES rank he/she is applying for and/or he/she is found to have poor managerial skills, has shown mediocre performance, or has a highly questionable integrity.
ARTICLE III
Other Requirements for Appointment to a Career Executive Service (CES) Rank
SECTION 1. Other Requirements for Original and Promotional Appointment to a CES Rank. — In addition to the basic requirements for original and promotional appointment to a CES rank, a CESO or CES eligible is required to submit the following documentary requirements:
a. Clearances from the following offices:
1. Department or Agency of the CESO or CES Eligible
2. Civil Service Commission
3. Sandiganbayan
4. Office of the Ombudsman
5. Presidential Anti-Graft Commission
6. National Bureau of Investigation
b. Self-certification issued by the CESO or CES eligible under oath stating that he/she has no pending administrative or criminal case/s;
c. Copy of appointment paper and service record duly certified by the Office Personnel/Administrative Officer;
d. Copies of training certificates duly certified by an authorized personnel of duly accredited training institutions; and,
e. Endorsement of a Department Secretary/Agency Head.
SECTION 2. Prohibition on Appointment to a CES Rank. — No CESO or CES eligible shall be appointed to a CES Rank six (6) months prior to his/her retirement from government service.
SECTION 3. Guidelines on Appointment to a CES Rank of a CESO with Pending Cases. — The following are the guidelines on appointment to a CES rank of a CESO with pending cases:
a.) On cases pending before the Office of the Ombudsman:
i.) if the case filed does not involve moral turpitude, the Board shall recommend the CESO for appointment to a CES rank, after an exhaustive review of the case.
ii.) If the case involves moral turpitude, the Board shall not endorse the appointment to a CES rank until such time that the CESO concerned is finally cleared or exonerated of the charges filed.
b.) On cases pending before the Sandiganbayan: Such instances would constitute a bar for the Board to recommend a CESO for appointment to a CES rank until such time that he/she is finally cleared or exonerated of the charges filed against him/her.
c.) On cases filed with the regular courts or quasi-judicial bodies:
i.) If the case filed does not involve moral turpitude, the Board shall recommend the appointment to a CES rank of a CESO.
ii.) If the case involves moral turpitude, the Board shall not endorse the appointment to a CES rank of the concerned CESO until such time that he/she is finally cleared or exonerated of the charges filed against him/her.
Moral turpitude is defined as an act of baseness, vileness, or depravity in the private and social duties which a man owes his fellow men, to society in general contrary to the accepted and customary rule of right and duty between man and man, or conduct contrary to justice, honesty, modesty, or morals; essentially, it includes all crimes of which fraud is an element.
ARTICLE IV
Final Provisions
SECTION 1. Separability Clause. — If any section or part of this resolution shall be held to be invalid, the remaining provisions shall be given full force and effect as if the part held invalid had not been included therein.
SECTION 2. Repealing Clause. — All existing CES rules and regulations, circulars and memoranda inconsistent with this resolution are hereby repealed or amended accordingly.
SECTION 3. Effectivity. — This resolution shall take effect fifteen (15) days after publication in a newspaper of general circulation or in the Official Gazette.
