BI MEMORANDUM ORDER NO. AFF-06-015
REVALIDATION OF VISAS
All visa applications for change of status from temporary visitor's visa under Section 9 (a) of the Philippine Immigration Act (PIA), as amended, to another visa category, whether non immigrant or immigrant visa, under the PIA or other special laws, and for the extension of non immigrant or immigrant visas, approved by the Board of Commissioners (BOC), but not yet implemented because the applicant left the Philippines, may be revalidated, provided that:
(a) A request for revalidation shall be filed with the Executive Office within fifteen (15) working days from applicant's date of arrival;
Failure of the applicant to file the application for revalidation within the period of 15 days shall be a ground for denial of the application. In exceptional cases, where the circumstances warrant the extension of the period of filing of the application, the same may be approved, provided, that an affidavit of justification stating the reason/s for the failure to file the request within 15 days is submitted by the applicant.
The Executive Director may accept applications filed beyond the period of 15 days due to the following reasons: (1) failure of the applicant to receive notice of the approval of visa; 2) physical incapacity of the applicant due to accidents or illnesses; 3) work related or business related concerns; 4) family concerns; or such other reasons which may be determined by the Executive Director to be valid, and shall be duly substantiated.
In the absence of the Executive Director, the Acting Assistant Executive Director, shall exercise the discretion in accordance with the guidelines stated herein.
b. The applicant returns to the Philippines within three (3) months from his last departure, with a valid entry visa;
c. The BOC-approved visa is still valid at the time of filing of the request for revalidation; and
d. The applicant is not among the class of excluded aliens under Section 29 of the PIA, as amended. IaAScD
This memorandum supersedes all memoranda previously issued on the matter of revalidation of visas and shall take effect immediately.
