BI OPERATIONS ORDER NO. SBM-2015-002
CREATION OF CANCELLED SPECIAL VISAS LIST
WHEREAS, several laws provide the issuance of Special Visas, such as, but not limited to, PEZA 1 visas, Subic 2 -Clark visas, ASEZA 3 visas, CEZA 4 visas, SIRV, 5 SRRV 6 and CA613, 47 (a) (2) visas. 7
WHEREAS, Special Visas are covered by immigration reportorial requirements.
WHEREAS, there is a need to include in the BI computer database the names and personal circumstances of foreigners with cancelled Special Visas;
NOW THEREFORE, pursuant to the Commissioner's rule-making authority under Commonwealth Act No. 613, Section 3, the following shall be observed: DTAcIa
SECTION 1. Duties of the MISD. — The MISD is directed to create within (30) days hereof a program: "Cancelled Special Visas List".
The Cancelled Special Visas List shall contain the names and other personal circumstances of foreigners with cancelled Special Visas.
The Cancelled Special Visas List in the BI's computer database shall be accessible to immigration officers at the ports of entry and exit and to other Divisions at the BI Main Office through the BI CQSS.
SECTION 2. Duties of the Immigration Regulation Division. — Within 48 hours from receipt of the letter of records 8 informing the BI about the cancellation of the foreigners' Special Visas, the immigration Regulation Division (IRD) shall draft an Order for the signature of the Commissioner directing the MISD to include the names of the subject foreigners in the Cancelled Special Visas List.
SECTION 3. Not a Derogatory Record. — The inclusion of the foreigner's name in the Cancelled Special Visas List shall not be deemed a derogatory record. The list shall serve as a monitoring tool for the BI.
In case the issuing Entity of the Special Visas requested the inclusion of the subject foreigners names in the derogatory lists (Blacklist, Hold Departure List, Watchlist or Alert List), their names shall be included simultaneously in the derogatory lists and the Cancelled Special Visas List.
SECTION 4. Repealing Clause. — All rules, procedures, guidelines and previous issuances inconsistent herewith are hereby repealed and/or modified accordingly.
