GPPB RESOLUTION NO. 030-14
REQUEST FROM THE SENATE BLUE RIBBON SUB-COMMITTEE FOR ADDITIONAL TIME TO CONDUCT FULL STUDY ON REPUBLIC ACT NO. 9184, OTHERWISE KNOWN AS THE GOVERNMENT PROCUREMENT REFORM ACT, TO IDENTIFY AREAS FOR POSSIBLE AMENDMENTS
WHEREAS, pursuant to Section 63 of RA 9184 and its Implementing Rules and Regulations (IRR), it is the Government Procurement Policy Board's (GPPB) function, among others, to protect national interest in all matters affecting public procurement, having due regard to the country's regional and international obligations; formulate and, amend, whenever necessary, the IRR and the corresponding standard forms for procurement; and conduct an annual review of the effectiveness of RA 9184 and recommend any amendments thereto, as may be necessary; AaCTcI
WHEREAS, on 21 November 2014, the Government Procurement Policy Board-Technical Support Office (GPPB-TSO) received a request letter dated 20 November 2014 from the Senate Blue Ribbon Sub-Committee on Accountability of Public Officers and Investigations for proposed amendments on existing laws on public procurement in order to strengthen the enforcement powers;
WHEREAS, on 28 November 2014, the GPPB-TSO requested from the Senate Blue Ribbon Sub-Committee for an extension of fifteen days from 1 December 2014 or until 16 December 2014, within which to comply with the directive so as to have ample time to present the matter to the GPPB for consideration;
WHEREAS, the request letter, together with the list of areas or provisions of the procurement law for possible amendments, were presented to the GPPB and the Inter-Agency Technical Working Group (IATWG) in its joint meeting on 5 December 2014 for consideration; acEHCD
WHEREAS, major procuring entities of the government are conducting a comprehensive review of the law and possible amendments that may be introduced thereto;
WHEREAS, after careful deliberations and consideration of the request, the GPPB resolved to direct the GPPB-TSO to request from the Senate Blue Ribbon Sub-Committee an extension of six (6) months from December 16, 2014 to June 15, 2015, to conduct a full study of the areas of the procurement law wherein possible amendments may be introduced; EcTCAD
NOW, THEREFORE, for and in consideration of the foregoing, WE, the Members of the GOVERNMENT PROCUREMENT POLICY BOARD, by virtue of the powers vested on US by law, hereby RESOLVE to confirm, adopt and approve, as WE hereby confirm, adopt and approve to DIRECT the GPPB-TSO, through its Executive Director, to request from the Senate Blue Ribbon Sub-Committee an extension of six (6) months from December 16, 2014 to June 15, 2015, to conduct a full study of the areas of the procurement law wherein possible amendments may be introduced.
