Repealing R.A. No. 3741 (Private Financing Law)
Presidential Decree No. 1005, enacted on September 22, 1976, repeals Republic Act No. 3741, which allowed private persons to construct self-liquidating public improvements under the Private Financing Law. The decree emphasizes that the Department of Public Works, Transportation and Communications will be the main government agency responsible for infrastructure development, ensuring alignment with national priorities. It allows for the continued collection of tolls on existing projects and permits the private sector to participate in public works, but emphasizes that the focus should be on social and economic contributions rather than just self-liquidation. Additionally, the Secretary of Finance and other officials are tasked with creating rules for the orderly transition of existing contracts to government control.
