LTFRB MEMORANDUM CIRCULAR GT NO. 2007-004

Pursuant to Section 5 (k) of Executive Order No. 202 provides that the Board shall have the power and functions "to formulate, promulgate, administer, implement and enforce rules and regulations on land transportation public utilities . . ., and Section 13 (a) of Com. Act 146, as Amended, that the Commission (now LTFRB) "shall have jurisdiction, supervision and control over all public services and their franchises, equipment and other properties, . . . . Likewise, Section 5 (1) of the aforesaid Executive Order empowers the Board "to coordinate and cooperate with other government agencies and entities concerned with any aspect involving public land transportation services with the end in view of effective continuing improvement of such services."
Pursuant and consistent with the above-quoted powers and functions provided by laws, the Land Transportation Franchising and Regulatory Board (LTFRB) is mandated to create its own Law Enforcement Unit which shall be in close coordination with the Land Transportation Office (LTO), Traffic Management Group-Philippine National Police (TMG-PNP), Metro Manila Development Authority (MMDA) and other non-government organizations (NGOs).
Likewise, the LTFRB shall have an Adjudication and Investigation Unit which shall have the power and function to investigate cases of contested and Uncontested apprehensions by the LTFRB Law Enforcement Unit involving violations of the terms and conditions of certificates of public convenience and other policies, rules and regulations of the Board.
Further, the LTFRB shall have the power to deputize selected personnel from government and non-government organizations and other cause oriented groups and/or associations in order to assist in the performance of its law enforcement mandate. Deputized personnel shall be entitled to benefits incentives and other privileges provided by the LTFRB.
The LTFRB shall provide and formulate the rules and regulations to implement this Memorandum Circular including the corresponding scale of fines and/or penalties for acts in breach or violation of LTFRB orders, policies, rules and regulations.
This Memorandum Circular cancels and supersedes any and all issuances inconsistent herewith and shall remain in force until further Order. TAScID
This Memorandum Circular shall take effect fifteen (15) days following the filing of three (3) copies hereof with the UP Law Center, pursuant to Presidential Memorandum Circular No. 11, dated 09 October 1992 and after its publication in a newspaper of general circulation or in the Official Gazette.
