BI OPERATIONS ORDER NO. SBM-2014-016
ORDER TO LEAVE AND INCLUSION IN THE BLACKLIST OF REGISTERED SEX OFFENDERS
Whereas, foreign nationals who are registered sex offenders clearly pose a threat to public safety. ETIcHa
To ensure the speedy proceedings against foreign nationals who are registered sex offenders, the following guidelines shall be observed:
A. Office of the Commissioner and/or Other BI Offices:
1. Within twenty four (24 hours) from receipt of the letter or records ("sex offender file") from the authorized personnel of a foreign embassy informing that a certain foreign national is a registered sex offender, the Office of the Commissioner (OCOM) and/or other BI Offices shall indorse the sex offender file to the Legal Division (LD).
B. Legal Division:
1. Within forty eight (48 hours) from the receipt of the sex offender file, the LD shall draft the following order:
a. In case the registered sex offender is outside the Philippines, the LD shall draft an Order directing the inclusion of the foreign national's name in the Blacklist.
b. In case the registered sex offender is inside the Philippines, the LD shall draft an Order to Leave within fifteen (15) days with Blacklist against the foreign national.
c. In case the registered sex offender holds a visa other than a Temporary Visitor Visa, the LD shall commence the forfeiture proceedings against the subject foreign national. The visa forfeiture order shall include the Order to Leave with Blacklist.
2. In case of failure to comply with the Order to leave, the LD shall commence deportation proceedings against the registered sex offender pursuant to CA 613, Sec. 37.
3. The LD shall ensure that the relevant immigration information of the registered sex offender shall be attached to the records such as but not limited to: (1) travel records, (2) alien registration records and/or (3) derogatory records. The same shall form part of the sex offender file. HISAET
