PROCLAMATION NO. 2204
EXCLUDING CERTAIN AREA FROM THE OPERATION OF PROCLAMATION NO. 223 DATED NOVEMBER 16, 1937 AND OPENING THE SAME FOR MINING PURPOSES
WHEREAS, our economic development program requires the progressive and orderly exploitation of mineral resources;
WHEREAS, pursuant to Section 3(o) of Commonwealth Act No. 136, the President of the Philippines issued Executive Order No. 245, dated July 10, 1970, prescribing the procedures of mineral prospecting and exploitation in government reservation other than mineral reservation; casia
WHEREAS, in accordance with Executive Order No. 245 and Presidential Decree No. 463, Dra. Lourdes S. Pascual was duly granted, first a prospecting permit by the Bureau of Forest Development and subsequently, an exploration permit by the Bureau of Mines and Geo-Sciences, over certain parcel of the Biak-Na-Bato National Park;
WHEREAS, by virtue of a Deed of Assignment dated July 9, 1981, the Permittee, Dra. Lourdes S. Pascual transferred her rights over the area in favor of Rosemoor Mining and Development Corporation;
WHEREAS, various investigation, exploration works and feasibility studies caused to be undertaken by the applicant Rosemoor Mining and Development Corporation and verified by the Bureau of Mines and Geo-Sciences revealed that the applied area is valuable for mining purposes and that the limestone deposit therein could be commercially exploited for marble blocks, marble slabs, agricultural and industrial lime products; casia
WHEREAS, applicant Rosemoor Mining and Development Corporation after having complied with the requirements under Executive Order No. 245, series of 1970, and Sec. 101 of the Consolidated Mines Administrative Order implementing P.D. 463, otherwise known as the "Mineral Resources Development Decree of 1974", now requests the exclusion of the applied area from the Biak-Na-Bato National Park;
NOW, THEREFORE, I, FERDINAND E. MARCOS, President of the Philippines, by virtue of the powers vested in me by law, do hereby order and decree that a parcel of land within the Biak-Na-Bato National Park established under Proclamation No. 223 dated November 16, 1937, be excluded from the operation of said Proclamation and hereby award the development, exploitation and utilization of the minerals therein to Rosemoor Mining and Development Corporation, subject to existing rights, if any there be, and to existing policies, laws, rules and regulations pertinent thereto, which parcel of land is particularly described as follows:
Beginning at a point "1" (15º 07'45", 121º 04'45") on plan of mining claims AQL-924 to AQL-927 corresponding to Permit to Prospect No. 566-73181 inside Biak-Na-Bato National Park at Doña Remedios Trinidad (formerly San Miguel), Bulacan, thence N 00º 01'W, 2,304.97 m. to point 2 (15º 09'00", 121º 04'45"); thence N 89º 59'E, 1,343.39 m. to point 3 (15º 09'00", 121º 05'30"); thence S 00º 01'E., 1,843.97 m. to point 4 (15º 08'00", 121º 05'30"); thence N 89º 59'E, 447.84 m. to point 5 (1º 08'00", 121º 05'45"); thence S 00º 61'E, 460.99 m. to point 6 (15º 17'45", 121º 05'45"); thence S 89º 59'W, 1,791.37 m. to point 1 which is the point of beginning, containing an area of 330,3062 hectares, more or less, as indicated in the attached Survey Plan.
