PVAO OFFICE ORDER NO. 011-07
NEW GUIDELINES ON DISPOSITION OF ACCRUED AND UNCOLLECTED PENSIONS
Pursuant to Section 52 of DO # A-042 (Implementing Rules of RA #6948), the following guidelines shall apply in the processing and payment of accrued and uncollected pensions:
1. Entitlement — In case of death of veteran or spouse, the accrued and uncollected pension shall be claimed in due form by the lawful heirs in the manner and form provided herein. Such accrued and uncollected pension shall be paid and released in the individual name of the qualified lawful heirs.
2. Documentary Requirements — Claims for the payment of accrued and uncollected pension shall be supported by the following documents:
a. Proof of Death — Death Certificate issued by Local Civil Registrar (LCR) and National Statistics Office (NSO) both with corresponding official receipt of payment. cDIHES
b. Proof of Relationship — Certificates of Birth and Marriage issued by the Local Civil Registrar (LCR) and National Statistics Office (NSO) both with corresponding official receipt of payment;
The proper Philippine Embassy shall authenticate all documents issued abroad.
3. Processing of Claims — Application forms (PVAO A/P Form A) shall be issued only upon showing/determination of accrued and uncollected pension in the name of the deceased and no application form shall be accepted unless all the documentary requirements are complete. In all cases, the supporting documents shall be examined to ensure that the pensions go to the rightful claimants, without prejudice to further verification by PVAO.
4. Execution of voluntary agreement — In addition to the requirements stated in No. 2 herein, the qualified lawful heirs shall be required to execute an agreement (PVAO A/P FORM B) dividing among themselves the accrued and uncollected pension in the manner they see fit. Such notarized agreement shall be fully agreed into by all qualified lawful heirs and shall be the basis of disposition the amount of accrued and uncollected pension. In case of disagreement, the rules provided in the Rules of Court shall be applicable.
5. Payment of Claims — The whole amount corresponding the accrued and uncollected pensions shall be paid and distributed to the qualified lawful heirs in accordance with their notarized agreement, and as decreed in the PVAO Decree of Distribution.
6. Liability for fraud — Every person who knowingly or willfully or aids in presenting a fraudulent claim, certificates or document concerning claims for accrued and uncollected pension shall be barred from hereafter prosecuting any other benefits in addition to outright disapproval or nullification of his/her claim for entitlement to accrued and uncollected pension, without prejudice to criminal prosecution under existing laws. 7. Coverage of Pending Claims — Applications for payment of accrued and uncollected pensions pending upon the effectivity of this guidelines shall be processed in accordance with this new guidelines.
8. Repealing Clause — Upon its affectivity, this new guideline renders ineffective the previous Guidelines on Disposition of Posthumous Pension dated October 12, 2005.
9. Effectivity — This guideline shall take effect on June 1, 2007.
