ATO MEMORANDUM CIRCULAR NO. 01-06

| SUBJECT | : | Implementation of the Specific Provisions of Aeronautical Engineering Law |
By virtue of the statutory mandates of Air Transportation Office to be the sole government agency vested with authority to regulate, formulate and implement and impose rule/regulations relating to civil aviation/aeronautical practices, and in compliance with the provisions of Presidential Decree No. 1570, otherwise known as "Aeronautical Engineering Law of the Philippines", the following provisions are hereby implemented immediately:
1. All scheduled and non-scheduled airlines, air taxi operators, aircraft owners, aviation schools, maintenance and repair organizations, and other government agencies who are engaged in the operation of aircraft shall avail themselves of the services of registered aeronautical engineers;
2. All companies, entities, or persons shall submit engineering reports containing analysis, plants/drawing and substantiations of any civilian aircraft undergoing major repair, alteration, and/or modifications bearing the signature, seal, and registration number of a registered aeronautical engineer;
3. All aircraft operators shall conduct aircraft performance checks, weight and balance checks, symmetry and alignment checks, and other checks affecting the performance and structural integrity of the aircraft under the supervision and control of a registered aeronautical engineer;
4. All Administrative Orders 121 and 135 operators shall submit aircraft performance analysis/reports with certification of a registered aeronautical engineer' and
5. All companies, entities, or persons involved in the selling and distribution of aircraft parts and components shall avail themselves of the services of registered aeronautical engineers.
Any person who violates the above provisions shall be liable to penalties prescribed under Chapter VII (Violation and Penalties) of Republic Act 776, and Section 33 of PD 1570. TIaEDC
All orders, memoranda, and circulars that are in conflict herewith are accordingly rescinded, modified or otherwise amended.
