Guidelines in Instances Where there is Manifestation or Information that a Case Pending Before a Regular Court Involves a Minor
OCA Circular No. 11-2021 outlines the procedures for trial courts in the Philippines when a case involves a minor. Courts must first determine the age of the accused before proceeding with the case, in accordance with R.A. No. 9344 and its amendments. If the accused is found to be a minor at the time of the offense, the case must be re-raffled to a Family Court. Conversely, if the accused is not a minor, the court can continue with the proceedings. The circular emphasizes compliance with these guidelines to ensure proper handling of cases involving minors.
