SRA ORDER NO. 004, S. 2017-2018
| SUBJECT | : | Guidelines for Verification and Disposition of "D" or World Market Sugar |
WHEREAS, Section 2 B of Executive Order No. 18, Series of 1986 mandates the Sugar Regulatory Administration (SRA) to establish and maintain such balanced relationship between production and requirement of sugar and such marketing conditions as will ensure stabilized prices at levels reasonably profitable to the producers and fair to consumers;
WHEREAS, there is a need to provide guidelines for the timely disposition of the "D" sugar or World Market sugar in order to maintain an acceptable volume of stocks in the domestic warehouses even after the end of the crop year;
NOW, THEREFORE, under and by virtue of the authority vested in the Sugar Regulatory Administration, it is hereby ordered that:
SECTION 1. Procedures and Schedule of Verification and Shipping Deadlines. —
1.1 "D" sugar produced in Sugar Crop Year 2017-2018 shall have verification and shipping deadlines.
1.2 The application for verification shall correspondingly indicate the classification of sugar as "D", "E" or "F".
1.3 Hereunder is the deadline of submission of "D" sugar quedan-permits for verification, and shipment of food processor/manufacturers of sugar-based products for export and accredited ethanol producers.

1.4 Nomination of vessel by qualified sugar traders/exporters shall be required through an Undertaking to Ship for submission to the SRA prior to the deadline of shipment. TIEHDC
SECTION 2. The subject "D" quedans if not verified with the SRA on or prior to abovementioned deadlines shall be classified as "HOMELESS" quedans and its covering sugar is non-status or non-marketable sugar which cannot be withdrawn from the mills unless specifically authorized by the SRA.
SECTION 3. Deadline for Shipment or Commitment for Sale. — Exporters shall ship the "D" sugar to the World Market within the shipping deadline provided in Section 1. Likewise, "D" sugar must be committed for sale to food processor/manufacturers of sugar-based products for export or accredited ethanol producers within the deadline provided herein.
Failure to ship (for "D" sugar), or submit proof of commitment of sale (for CBW/Food Processors and Ethanol Producers) shall render the quedans homeless and non-marketable sugar which cannot be withdrawn from the mills unless specifically authorized by the SRA.
SECTION 4. Reportorial Requirements of Exporters of "D" World Market Sugar. — Exporters of "D" sugar shall submit to the Regulation Department, SRA, Quezon City within Fifteen (15) days after the shipment, proof of export to the country of destination the following:
1. Export Declaration
2. Bill of Lading
3. Packing List
4. Commercial Invoice
5. Notarized Affidavit with regard to the consignee's name/address/contact details and
6. Customs Clearance from port of entry/country of destination.
SRA shall not process any further clearances unless the requirements under this Sugar Order are complied with and verified as to the authenticity of the documents submitted.
SECTION 5. The Implementing Rules and Regulations (IRR) in the availment of "D" World market sugar by the food processors/manufacturers of sugar-based products for exports per Circular Letter No. 25, Series of 2016-2017 and the requirements for reclassification of "D" world market sugar to fermentable sugar per Sugar Order No. 5, Series of 2008-2009 shall apply.
SECTION 6. The application for verification of the subject "D" quedans shall be filed at the Regulation Department, SRA, Quezon City and Bacolod Office while the application for food processors/manufacturers of sugar-based products for export, export to the world market and fermentable sugar shall be filed in the Regulation Department, SRA, Quezon City. SECTION 7. This Order shall take effect fifteen (15) calendar days from its issuance.
SECTION 8. Provisions of Sugar Orders, Circular Letters, rules and regulations contrary to or inconsistent with this Sugar Order is hereby revised, modified or revoked.
