DOTC-OTS MEMORANDUM CIRCULAR NO. 01-16

Pursuant to EO 277 as amended by EO 311, in reference to Annex A thereof otherwise known as the National Civil Aviation Security Program (NCASP), in compliance with the ICAO standards and recommended practices (SARPS) provided in Chapter 3, paragraph 3.1.1 and 3.1.2 of Annex 17 (ICAO Convention), this office as the Appropriate Authority, and pursuant to Executive Order 292 otherwise known as the Administrative Code of the Philippines, hereby adopts and issues this clarification and guidance:
I. Rationale and Objective
This memorandum circular clarifies and updates for effective and efficient implementation the National Civil Aviation Security Quality Control Program (NCASQCP) and National Civil Aviation Security Training Program (NCASTP) as adopted and approved by the President pursuant to Executive Order #277 by incorporating ICAO convention updating amendments to the SARPS of Annex 17 (Security) to the ICAO Convention by the issuance of needed revising editions.
II. Coverage
This will cover the National Civil Aviation Security Quality Control Program (NCASQCP) and National Civil Aviation Security Training Program (NCASTP) and its updating editions, incorporating the amendments to Annex 17 (ICAO) for update in accordance with the Convention.
III. Guidance
a. In relation to Memorandum Circular No. 2015-01 clarifying the implementation of the NCASP, the obligation/responsibility of OTS to develop and implement an NCASTP and NCASQCP is derived from the provisions of Sections 3.1.6 and 3.4.4 of Annex 17 to the Chicago Convention.
b. Similar to the NCASP, the NCASTP and NCASQCP are a dynamic documents maintained and sustained by OTS as mandated by law and is responsible for the security of the civil aviation in the country by ensuring our compliance with ICAO treaty obligations. NCASTP and NCASQCP revised and updating editions are issued periodically to maintain, sustain and update the Program for efficacy and efficiency (EO#311).
c. The NCASQCP, then the National Testing Protocol, and the NCASTP were first adopted as an appendices to the 2004 NCASP.
d. The first revised edition of the NCASQCP and the NCASTP were issued on April 2004 to comply with Amendment 10 of Annex 17 requiring the appropriate authority (OTS) to develop, implement and maintain an NCASQCP and NCASTP to determine compliance with and validate the effectiveness of its NCASP and other.
e. To incorporate Amendment 11 to Annex 17 and Document 8973/7 (Security Manual for Safeguarding Civil Aviation Against Acts of Unlawful Interference), OTS, on 16 December 2008, issued the second revised edition of the NCASQCP.
f. The second revised edition of the NCASTP was issued on 2013 to incorporate Amendment 12, 13 and 14 of Annex 17 and Doc 8973, establishing policies on the Recruitment, Selection and Training of Aviation Security Personnel.
IV. n Miscellaneous Provisions
a. Construction.The provisions herein shall be liberally construed in order to promote civil aviation security objectives.
b. Reservation. Nothing herein shall be construed as precluding OTS, through its Administrator, from implementing the provisions enunciated herein and in prescribing other requirements to meet the constantly evolving challenges in civil aviation security.
c. Amendments. Nothing in this circular shall restrict the authority of OTS, through its Administrator, to modify, amend or repeal any provision of this circular by subsequent issuances.
d. Repeal. All orders, rules, regulations and issuances, or parts hereof, which are inconsistent with this circular, are hereby accordingly repealed or modified.
e. Separability.If any provision or section of this circular is declared null and void by competent authority, the remaining provisions thereof shall not be affected and shall remain in full force and effect.
f. Effectivity. This circular shall take effect fifteen (15) days following its publication in the Official Gazette or newspaper of general circulation. A copy of this circular shall be deposited with the University of the Philippines Law Center, in compliance with the Revised Administrative Code.
