Grant and Release of Christmas Cash Gift to the Justices, Officials and Personnel of the SC, PET, CA, Sandiganbayan and the CTA

SUPREME COURT MEMORANDUM ORDER NO. 56-10

AUTHORIZING THE GRANT AND RELEASE OF CHRISTMAS CASH GIFT TO THE JUSTICES, OFFICIALS AND PERSONNEL OF THE SUPREME COURT, PRESIDENTIAL ELECTORAL TRIBUNAL, COURT OF APPEALS, SANDIGANBAYAN AND COURT OF TAX APPEALS

WHEREAS, by virtue of, and pursuant to, his authority under the Constitution to augment items in the budget for the Supreme Court and the Presidential Electoral Tribunal (PET) from savings in other items therein and under Joint Resolution No. 1, dated 3 April 1992, of the Constitutional Fiscal Autonomy Group (CFAG) on the establishment and use of the Fiscal Autonomy Account, the Chief Justice has been authorizing, for the past years at Christmas time, the grant of Christmas cash gifts to the justices, officials and personnel of the Supreme Court from the savings or fiscal autonomy account;

WHEREAS, as reported by the Fiscal Management and Budget Office (FMBO) of the Supreme Court, there are enough savings from the regulars appropriations of the Supreme Court and the PET and sufficient amount in the Fiscal Autonomy Account for the grant of Christmas cash gift in the amount of TWENTY-FIVE THOUSAND PESOS (P25,000.00) for each of the justices, officials and personnel of the Supreme Court;

WHEREAS, Christmas cash gift in the amount of TWENTY-FIVE THOUSAND PESOS (P25,000.00) may likewise be granted to each of the justices, officials and personnel of the three appellate courts (Court of Appeals, Sandiganbayan and Court of Tax Appeals) chargeable against the respective Fiscal Autonomy Accounts or the savings from the regular appropriations of the said appellate courts, as certified to by their respective proper officials;

IN VIEW OF THE FOREGOING, the Chief Justice hereby authorizes the grant and release of:

1) TWENTY-FIVE THOUSAND PESOS (P25,000.00) as cash gift to each justice, official and personnel of the Supreme Court and the PET, which shall be charged against the respective Fiscal Autonomy Accounts of the Supreme Court and PET; and,

2) TWENTY-FIVE THOUSAND PESOS (P25,000.00) as cash gift to each justice, official and personnel of the Court of Appeals, Sandiganbayan and Court of Tax Appeals, which shall be charged against the respective savings or Fiscal Autonomy Accounts of the three appellate courts. cAaETS

The benefit herein granted shall be received in its full amount by those who are in the service for eleven months or more as of November 30, 2010 and shall be subject to the implementing guidelines hereto attached.

The Clerk of Court, the Chiefs of the FMBO and the Office of Administrative Services, Supreme Court shall work together to implement this Memorandum Order.

Likewise, the Presiding Justices of the Court of Appeals, Sandiganbayan and the Court of Tax Appeals shall implement this Memorandum Order insofar as their respective courts are concerned.

This Memorandum Order shall take effect upon its issuance.
