Formalities in the Arrival and Departure of Philippine Citizen with Dual or Multiple Citizenship

FORMALITIES IN THE ARRIVAL AND DEPARTURE OF PHILIPPINE CITIZEN WITH DUAL OR MULTIPLE CITIZENSHIP

Immigration Officers in all airports and ports of entry shall observe the following formalities concerning the arrival and departure of Philippine citizens with dual or multiple citizenship

I. Proof of Philippine Citizenship

(i) A valid Philippine passport;

(ii) Identification Certificate (IC); or

(iii) Certificate of Re-acquisition/Retention of Philippine Citizenship (CRPC)

II. Arrival

Arriving Philippine citizen with dual or multiple citizenship shall be admitted as a Philippine citizen upon presentation of any of the proof listed in Item I.

In cases where such citizen presents both a foreign passport and a valid Philippine passport, the Immigration Officer (IO) shall: (a) Admit him as a Philippine citizen; and (b) Stamp both passports.

If the Philippine citizen presents only a foreign passport, but presents an IC or a CRPC, the IO shall: (a) Admit him as a Philippine Citizen; (b) Stamp the foreign passport with a notation that an IC or a CRPC was presented, as the case may be; and (c) Indicate in the database remarks section the presentation of IC or CPRC, as the case may be.

III. Departure

Departing Philippine citizen in possession of any of the proof in Item I with dual or multiple citizenship shall be cleared for departure as a Philippine citizen. The immediately preceding formalities shall likewise be observed. aIcCTA

IV. Blacklisted Philippine Citizen With Dual or Multiple Citizenship

In circumstances where a Philippine citizen with dual or multiple citizenship arrives but his name appears in the immigration blacklist, the following procedures shall be observed:

1. The passenger shall be admitted as a Philippine citizen upon presentation of any of the proof listed in Item I.

 If a Philippine passport is presented together with the foreign passport, the IO concerned shall stamp the Philippine passport only;

2. If the Philippine citizen presents a foreign passport but likewise presents either an IC or a CRPC, the Immigration Officer shall:

(i) Admit the passenger as a Philippine citizen;

(ii) Stamp the foreign passport with a notation that the passenger presented IC or CRPC, as the case may be; and

(iii) Indicate in the database remarks section that the passenger was admitted as a Philippine citizen who presented an IC or a CRPC, as the case may be;

3. The IO, through the Chief Airport Operations Division, shall prepare a separate Note With Recommendation (NWR) addressed to the Commissioner stating the circumstances surrounding the admission of the blacklisted Philippine citizen;

4. The case shall be referred to the Legal Division (LD) for processing the lifting of the blacklist order under reasonable grounds.

This shall take effect immediately upon approval.

All other issuances or any part thereof inconsistent with this Order are revoked/modified accordingly.

Furnish copies to the Office of the National Administrative register (ONAR), UP Law Center, Diliman, Quezon City.
