EXECUTIVE ORDER NO. 901
EXTENDING THE AVAILABILITY OF THE FY 2010 APPROPRIATIONS FOR MAINTENANCE AND OTHER OPERATING EXPENSES AND CAPITAL OUTLAYS TO DECEMBER 31, 2011
WHEREAS, Section 1 of the General Provisions of Republic Act No. 9970 or the FY 2010 General Appropriations Act (GAA)reads: cCSDaI
"Section 1. Appropriation of Funds. — The following sums, or so much thereof as may be necessary, are hereby appropriated out of the funds in the National Treasury of the Philippines not otherwise appropriated, for the operation of the Government of the Republic of the Philippines from January one to December thirty-one, two thousand and ten, except as otherwise specifically provided herein:";
WHEREAS, in the past several years, the appropriations for maintenance and other operating expenses (MOOE) and capital outlays were available for release and obligation for a period extending one fiscal year after the end of the year in which such items were appropriated;
WHEREAS, Section 28, Chapter 4, Book VI of Executive Order No. 292 or the Administrative Code of 1987 provides that appropriations for MOOE and capital outlays may be specifically recommended and approved to be made available beyond one fiscal year in support of projects whose effective implementation calls for multiyear expenditure commitments;
WHEREAS, such extension of appropriations is necessary for the effective implementation of multiyear projects, the benefits of which extend beyond the fiscal year;
NOW, THEREFORE, I, GLORIA MACAPAGAL-ARROYO, President of the Republic of the Philippines, by virtue of the powers vested in me by the Constitution and laws, do hereby order and direct:
SECTION 1. Availability of Appropriations. — The appropriations for MOOE and capital outlays in the FY 2010 GAA shall be available for release and obligation for the purpose specified thereunder and with the same special and general provisions applicable thereto for a period extending December 31, 2011.
SECTION 2. Effectivity. — This Executive Order shall take effect immediately.
