REPUBLIC ACT NO. 4824
AN ACT ESTABLISHING SEPARATE OFFICER PROMOTION LISTS FOR THE PHILIPPINE CONSTABULARY
SECTION 1. The provision of any law to the contrary notwithstanding, there shall be established separate promotion lists for regular officers and reserve officers of the Philippine Constabulary to be initially composed of officers who may be transferred to these lists from the existing regular force promotion list (Ground Force) and reserve force promotion list (Ground Force), respectively. cdt
SECTION 2. Transfer of officers to the regular officers and reserve officers promotion lists of the Philippine Constabulary shall be made, under such rules and regulations as the Secretary of National Defense shall prescribe, to meet the officer requirements of the Philippine Constabulary: Provided, That such transfers shall be limited to officers belonging to the promotion lists mentioned in Section one hereof: Provided, further, That within a period of one year after the approval of this Act, the existing authorized officer strength of the Philippine Constabulary, with the exception of officers belonging to the Medical Service, Dental Service, Judge Advocate General's Service, and Chaplain Service, shall be filled by officers transferred to the Philippine Constabulary promotion lists under this Act: Provided, further, That the resultant grade distribution of regular officers to be transferred to the Philippine Constabulary promotion lists under the immediately preceding proviso shall be in the same proportion, as the "Table of Organization positions for" the officers in the Regular Force promotion list (Ground Force) existing on the date of approval of this Act: Provided, further, That whenever possible the selection of regular and reserve officers to be transferred to the Philippine Constabulary, promotion list shall be made from the following groups: Graduates of the Philippine Constabulary Academy and the Philippine Military Academy; officers who were integrated into the Regular Force in the year nineteen hundred fifty on the basis of having passed the examination prescribed for Philippine Constabulary officer; officers assigned to the Constabulary on the date of approval of this Act who have served continuously and satisfactorily therein for at least one year; and officers who, since liberation, have served longer in the Constabulary than in the Army: Provided, further, That one year after the effectivity of this Act, transfers from the Philippine Constabulary promotion list to any other promotion list or vice versa except the Philippine Constabulary quota of graduates of the Philippine Military Academy shall not be permitted: And provided, finally, That the Secretary of National Defense may from time to time, detail for duty with the Philippine Constabulary, officers belonging to the Medical Service, Dental Service, Judge Advocate General's Service, Chaplain Service, Air Force, and Navy, as may be required.
SECTION 3. All existing laws, rules and regulations governing the procurement, appointment, assignment, seniority, promotion, and elimination of officers of the Ground Force, Armed Forces of the Philippines are hereby made applicable to officers of the Philippine Constabulary promotion lists.
SECTION 4. Hereafter, promotion list officers of the regular Force, except those belonging to the Air Force, Navy, Judge Advocate General's Service, Chaplain Service, Medical Service, and Philippine Constabulary, shall be known as promotion list officers of the Philippine Army.
SECTION 5. This Act shall take effect upon its approval.
