A.M. No. 11-9-05-CTA
RESOLUTION
Sirs/Mesdames:
Please take notice that the Court en banc issued a Resolution dated October 4, 2011, which reads as follows:
"A.M. No. 11-9-05-CTA (Re: Donation of the Asian Development Bank to the Philippine Judiciary Academy [PHILJA] on Behalf of the Court of Tax Appeals [CTA] as to the Transfer of Ownership of the Hardware and Software Programs Which Shall be Utilized for the CTA Case Management Information System Kiosk). — The Court Resolved to:
(a) NOTE the Letter dated September 19, 2011 of Justice Adolfo S. Azcuna, Chancellor, PHILJA, assisted by Justice Justo P. Torres, Jr., Vice-Chancellor, transmitting the Letter dated September 16, 2011 of Court of Tax Appeals Presiding Justice Ernesto D. Acosta and Justice Juanito C. Castañeda, Jr.;
(b) AUTHORIZE the PHILJA to accept the subject donation and execute the necessary documents; and cHDEaC
(c) APPROVE the additional provisions to the draft Deed of Donation prepared by the Court of Tax Appeals, to wit:
(4) The Donee, through the Court of Tax Appeals, shall take charge of the maintenance of the donated equipment, after the warranty period embodied in the Contract of Sale between the Donor and the Leverage Systems Technologies, Inc.;
(5) Pursuant to paragraph A.1 of the "Guidelines in the Acceptance and Maintenance of Donations to the Philippine Judicial Academy of Computers and Information Technology Tools Necessary in the Administration of Justice," prescribed in a Resolution of the Court en banc dated December 9, 2003, the Property Division of the Office of Administrative Services and the Fiscal Management and Budget Office of the Supreme Court, will be furnished copies of the Deed of Donation and authorization from the Chief Justice/Court to accept the donation, for purposes of recording, accounting, and inventory. Thereafter, transfer the same to the Court of Tax Appeals, as end-user, for documentation purposes and issuance of corresponding memorandum receipts." (adv148)
