MEMORANDUM ORDER NO. 81

DIRECTING THE FORMATION OF A TECHNICAL WORKING GROUP TO STUDY THE PROPOSED REVOCATION OF PROCLAMATION NOS. 111 AND 112 (S. 2001)

WHEREAS, Republic Act (RA) No. 7903, also known as the "Zamboanga City Special Economic Zone Act of 1995," promotes the public policy to establish special economic zones in suitable and selected areas to promote sound and balanced industrial, economic, and social development;

WHEREAS, Section 3 of the same law provides that the specific metes and bounds of the Zamboanga City Special Economic Zone (ZAMBOECOZONE) shall be defined in a presidential proclamation issued for that purpose;

WHEREAS, Proclamation No. 111 (s. 2001) designated the land occupied by the San Ramon Prison and Penal Farm (SRPPF), Zamboanga City, as additional lands of ZAMBOECOZONE;

WHEREAS, Proclamation No. 112 (s. 2001) reserved a parcel of land in Upper Bunguiao and Upper Curuan, Zamboanga City as the relocation site of the SRPPF;

WHEREAS, the Department of Justice (DOJ) reports that the proposed relocation site of the SRPPF is not suitable for the establishment of prison facilities; and

WHEREAS, Republic Act (RA) No. 10575, otherwise known as the "Bureau of Corrections Act of 2013," adopts the public policy to promote the general welfare and safeguard the basic rights of every prisoner incarcerated in the national penitentiary.

NOW THEREFORE, the following are hereby ordered:

SECTION 1. Creation. — A Technical Working Group (TWG) is hereby constituted with the purpose of studying and coming up with recommendations for the resolution of the transfer of SRPPF.

The TWG is hereby directed to submit a report to the Office of the President on the actions taken within ninety (90) days from the issuance of the Order.

SECTION 2. Composition. — The TWG and shall be composed of representatives of the following agencies: ATICcS

 

Chairperson:	Department of Environment and Natural Resources (DENR)
Members:	Department of Justice (DOJ)
	ZAMBOECOZONE
	Department of the Interior and Local Government (DILG)
	Department of Budget and Management (DBM)
	National Economic and Development Authority (NEDA)

 

 

The Regional Development Council Region IX shall constitute the Secretariat of the TWG.

SECTION 3. Assistance and Cooperation. — All other departments, agencies, bureaus and offices of the government are hereby ordered to coordinate and extend assistance to the TWG to carry out its functions pursuant to this Order.

SECTION 4. Repealing. — All orders, issuances, rules and regulations or parts thereof which are inconsistent with the provisions of this Order are hereby repealed, amended, or modified accordingly.

SECTION 5. Separability. — If any provision of this Order is declared invalid or unconstitutional, the other provisions unaffected thereby shall remain valid and subsisting.

SECTION 6. Effectivity. — This Memorandum Order shall take effect immediately.
