MEMORANDUM ORDER NO. 19

CONCURRENCE OF THE PRESIDENT IN THE DEPUTATION OF THE ARMED FORCES OF THE PHILIPPINES, THE PHILIPPINE NATIONAL POLICE AND OTHER LAW ENFORCEMENT AGENCIES AND INSTRUMENTALITIES OF THE GOVERNMENT FOR THE 05 JANUARY 2018 PLEBISCITE TO RATIFY THE CREATION OF BARANGAY NAIBUAN IN SAN JOSE, OCCIDENTAL MINDORO

WHEREAS, the Commission on Elections (COMELEC), through its Resolution No. 10232 (s. 2017), resolved to request the concurrence of the President in the deputation of the Armed Forces of the Philippines (AFP), the Philippine National Police (PNP) and other law enforcement agencies and instrumentalities of the Government, in connection with the 05 January 2018 plebiscite to ratify the creation of Barangay Naibuan in the Municipality of San Jose, Province of Occidental Mindoro;

WHEREAS, Barangay Naibuan shall consist of Sitios Lagnas, Naibuan, Ibanag, Hobkob, Abong, Malumak, Kianay, Libertad, Lowaliw, Ilya, Yabat, Salidang, Upper Koywan, Dayaga and Timbangan, which shall be taken out of Barangay Batasan in the Municipality of San Jose, Province of Occidental Mindoro;

WHEREAS, Ordinance No. 33 (s. 2009) of the Sangguniang Panlalawigan of Occidental Mindoro approved the separation of Sitio Naibuan from Barangay Batasan of San Jose, Occidental Mindoro;

WHEREAS, Sangguniang Bayan of San Jose, Occidental Mindoro issued Resolution No. 4203 (s. 2017) which provides the fifteen (15) sitios that will comprise Barangay Naibuan; and

WHEREAS, pursuant to Section 2 (4), Article IX-C of the Constitution, the COMELEC is empowered to deputize, with the concurrence of the President, law enforcement agencies and instrumentalities of the Government, including the AFP, for the exclusive purpose of ensuring free, orderly, honest, peaceful, and credible elections.

NOW, THEREFORE, I, RODRIGO ROA DUTERTE, President of the Philippines, by virtue of the powers vested in me by the Constitution and existing laws, hereby concur with COMELEC Resolution No. 10232, deputizing the AFP, the PNP and other law enforcement agencies and instrumentalities of the Government, in connection with the 05 January 2018 Plebiscite to ratify the creation of Barangay Naibuan in the Municipality of San Jose, Province of Occidental Mindoro.

The foregoing law enforcement agencies and other concerned agencies are hereby directed to coordinate and cooperate with the COMELEC in the performance of their duties and functions.

This Memorandum Order shall take effect immediately.
