Authority to Talisay-Silay Milling Co., Inc. to Build Canals and Aqueducts

AN ACT AUTHORIZING THE TALISAY-SILAY MILLING CO., INC., OF TALISAY, OCCIDENTAL NEGROS, TO BUILD CANALS AND AQUEDUCTS ACROSS OR ALONG THE PUBLIC STREETS, ROADS, BRIDGES, AND PLACES OF THE MUNICIPALITIES OF SILAY, TALISAY, BACOLOD, AND MURCIA, OCCIDENTAL NEGROS, AND THE SURROUNDINGS AND BARRIOS THEREOF, UNDER CERTAIN CONDITIONS

SECTION 1. The Talisay-Silay Milling Co., Inc., of Talisay, Occidental Negros, is hereby authorized, upon permission granted by the Secretary of Commerce and Communications, on recommendation of the Provincial Board of Occidental Negros and the municipal council of Talisay, and subject to such conditions as in the judgment of said authorities may adequately protect the public interest, to construct, for private use, canals and aqueducts across and along the public streets, roads, bridges, and places of the municipalities of Silay, Talisay, Bacolod, and Murcia, Province of Occidental Negros, and the surroundings and barrios thereof, provided the construction and private use of such canals and aqueducts do not prevent or interfere with the public use of said public streets, roads, bridges, and places.

SECTION 2. The authority granted under the provisions of this Act to the Talisay-Silay Milling Co., Inc., of Talisay, Occidental Negros, shall be at all times subject to revocation by the Secretary of Commerce and Communications if in his judgment the public interest requires it.

SECTION 3. This authority is granted with the understanding and upon the condition that it shall be subject to amendment, alteration, or repeal by the Congress of the United States as provided in section twenty-eight of the Act of Congress approved August twenty-ninth, nineteen hundred and sixteen, entitled "An Act to declare the purpose of the people of the United States as to the future political status of the people of the Philippine Islands, and to provide a more autonomous government for those Islands," or by the Philippine Legislature, and that it shall be subject, in all respects, to the limitations upon corporations and the granting of franchises contained in said Act of Congress, and that all lands or rights of use or occupation of lands secured by virtue of this authority shall revert upon its termination to the Insular, provincial, or municipal governments which were the owners thereof upon the date on which this franchise was granted, and all property of the grantee, its successors or assigns used in connection with this authority shall become the property of the Insular Government.

SECTION 4. The grantee herein may, with the approval of the Secretary of Commerce and Communications first had, sell, lease, donate, convey or give in usufruct this authority and all property and rights acquired thereunder to any person or corporation: Provided, That for the purpose of such sale, lease, donation, conveyance, or giving in usufruct, it shall be necessary to file in the office of the Secretary of Commerce and Communications an agreement in writing by which the person or corporation in whose favor such sale, lease, donation, conveyance, or giving in usufruct is made, shall bind himself to comply with all the terms and conditions imposed upon the grantee by this authority, and to accept the same subject to all existing terms and conditions.

SECTION 5. All Acts and provisions of law inconsistent herewith are hereby repealed.

SECTION 6. This Act shall take effect on its approval.
