Authority to Labor Agents Who Are Duly Qualified Attorneys to Defend Indigent Accused Persons
Act No. 4152, enacted on November 28, 1934, authorizes qualified labor agents from the Bureau of Labor to defend indigent individuals in criminal cases without charge, with the prior approval of the Secretary of Labor. An indigent person is defined as someone with minimal assets or income, specifically those who do not own property exceeding five hundred pesos or have a monthly income greater than fifty pesos, and who can attest to their status through an affidavit. If a case is appealed to the Supreme Court, the labor agent must report the relevant facts and legal findings to the Secretary of Labor. This act aims to ensure that justice is served for those unable to afford legal representation.
