Approval of DMC Resolution No. 09-04, 'Clarifying the 30-Day Mediation Period'
On February 1, 2005, the Philippine Supreme Court approved Resolution No. 04-24, which clarifies the 30-day mediation period for cases referred to the Philippine Mediation Center (PMC) Unit. The mediation period starts when the parties are ordered to appear at the PMC and concludes when the originating court receives notice of the mediation's termination. If the 30-day period ends on a weekend or holiday, the case will be returned to the court on the next working day. Additionally, the PMC Unit is required to inform the referring court of the mediation outcome within 24 hours of its conclusion.

RESOLUTION NO. 04-24 RE: APPROVAL OF DMC RESOLUTION NO. 09-04, 'CLARIFYING THE 30-DAY MEDIATION PERIOD'
Gentlemen :
Quoted hereunder, for your information, is a resolution of the Court En Banc dated February 1, 2005. DaAETS
"A.M. No. 05-1-13-SC. — Re: Resolution No. 04-24 re: Approval of DMC Resolution No. 09-04, 'Clarifying the 30-day Mediation Period'. — The Court resolved to
(a) NOTE the Letter dated 6 January 2005 of Justice Ameurfina A. Melencio Herrera, Chancellor, PHILJA, transmitting Resolution No. 04-24, adopted by the PHILJA Board of Trustees at its 38th Meeting held on 9 December 2004; and
(b) NOTE and APPROVE the aforesaid Resolution No. 04-24 which approved DMC Resolution No. 09-04 'Clarifying the 30-day Mediation Period,' as follows:
'1. The mediation period commences on the date the parties are ordered to appear at the PMC Unit;
2. The mediation period ends on the day the originating court receives notice from the PMC Unit of the termination of mediation proceedings. In case the 30th day falls on a weekend or a holiday, the case shall be returned to the originating court the next working day; iatdclaws
3. It is the duty of the PMC Unit to notify the court, which referred the case for mediation, about the result of the mediation within 24 hours from termination of the mediation proceedings.'"
