Collection of Mediation Fees and Payment of Mediator's Fees
On July 19, 2005, the Philippine Supreme Court issued transitory guidelines regarding the collection and payment of mediator's fees. For mediation of cases filed before August 16, 2004, the fee structure is 70% of the mediation fee, with 50% payable at the start and the remainder if mediation is successful, based on a fee of 20% of the filing fee. For cases filed on or after August 16, 2004, the fees are fixed at P700 for successful mediation and P350 for unsuccessful mediation, sourced from the Mediation Fund. These guidelines are subject to modification by the Court and do not apply to cases mediated during the Settlement Period unless stated otherwise.

Sirs/Mesdames:
Quoted hereunder, for your information, is a resolution of the Court En Banc dated 19 July 2005.
"A.M. No. 04-8-12-SC. — Re: Collection of Mediation Fees and Payment of Mediator's Fees. — The Court Resolved, upon the recommendation of the Philippine Judicial Academy, to ISSUE the following transitory guidelines on the payment of mediator's fees:
1. For the mediation of mediatable cases filed before 16 August 2004 (even if referred to mediation thereafter), the following fee shall apply pursuant to A.M. No. 01-10-5-SC-PHILJA, dated 16 October 2001:
• 70% of the Mediation Fee, 50% of which shall be payable at the start of mediation and the balance payable if mediation is successful HaECDI
The Mediation Fee is 20% of the Filing Fee which shall not be less than P1,000 nor more than P10,000.
2. For the mediation of mediatable cases filed on or after 16 August 2004, the following fee shall apply:
• P700 for successful mediation
• P350 for unsuccessful mediation
This amount shall be taken, pursuant to Sec. 9, Rule 141, from the Mediation Fund (PMC Trust Fund II).
3. The foregoing fees shall be implemented unless otherwise modified by the Court.
4. These Guidelines shall not apply to cases mediated during the Settlement Period, unless otherwise provided." (adv113) aCTHDA
