An Act to Authorize the Filing in the Proper Court, under Certain Conditions, of Certain Claims of Title to Parcels of Land that have been Declared Public Land, by Virtue of Judicial Decisions Rendered within the Fifteen Years Next Preceding the Approval of this Act
Commonwealth Act No. 276, approved on June 3, 1938, allows individuals who possess parcels of land declared as public land to petition for the reopening of judicial proceedings if they were unable to file their claims within the required timeframe due to justifiable reasons. This applies specifically to cases where the land was subject to cadastral proceedings and has not been alienated or disposed of by the government. Petitioners have a two-year window from the Act's approval to file their requests, and the court will assess compliance with specified conditions, including the payment of taxes and penalties. If the court finds that all criteria are met, it can reopen the judicial proceedings as if no prior action had been taken.
