ACT NO. 3044

AN ACT MAKING APPROPRIATIONS FOR PUBLIC WORKS

SECTION 1. The following sums, or so much thereof as may be necessary, are hereby appropriated, out of any funds in the Insular Treasury not otherwise appropriated, to be at the disposal of the Director of Public Works for the purposes mentioned hereunder, subject to the provisions hereinafter set forth.

COMPLETION AND MAINTENANCE OF PUBLIC BUILDINGS AND OTHER UNCLASSIFIED PROJECTS

(a)	For the completion of the construction of
	barracks for the Philippine Constabulary	P30,000.00
(b)	(1) For the completion of normal school
	buildings	245,000.00
	(2) For aid to regularly organized
	municipalities for the construction or
	completion of elementary schools	200,000.00
(c)	For the construction and completion of the
	following buildings, including suitable
	furniture and fixtures and the acquisition and
	improvement of the necessary grounds: (1)
	For the use of the Legislature; (2) for nurses'
	dormitories at the General Hospital; (3) for
	buildings for radio stations; (4) for the
	purchase and construction of masts and towers
	and material for antenna bases; (5) for the
	radio station at Basco, including tower; (6)
	for the engineering laboratory of the University
	of the Philippines; (7) for the chemical
	laboratory of the University of the Philippines;
	(8) for the operating ward at Zamboanga;
	(9) for the hospital at Kiangan; (10) for offices
	for the Supreme Court: Provided, however,
	That the plan of the building for the use of the
	Legislature shall be approved by the Capitol
	Committees of the Senate and House of
	Representatives: Provided, further, That the
	appropriations made for buildings by this and
	previous Acts shall, with the approval of the
	Governor-General also be available for the
	purchase of the necessary land	1,050,000.00

CONSTRUCTION AND MAINTENANCE OF ROADS AND BRIDGES

 

(e)	For the maintenance and improvement of the
	Benguet and Naguilian Roads and the road
	from Camp One to Damortis	100,000.00
(f)	For the maintenance, reconstruction and
	improvement of trails, roads, and bridges in
	such specially organized provinces as shall
	comply with the provisions of section 2115
	of Act No. 2711 and which, by a resolution
	of the provincial board, shall guarantee by
	continuing annual appropriations the
	establishment of such a system of
	maintenance as may be necessary in the
	judgment of the Director of Public Works on
	all trails, roads, and bridges now constructed
	or which may be constructed in the future	200,000.00
(g)	For the maintenance, reconstruction,
	improvement, and, where practicable, for the
	construction of roads and bridges in such
	regularly organized provinces as shall comply
	with the provisions of section 2113 of Act
	No. 2711 and which, by resolution of the
	provincial board, shall guarantee by continuing
	annual appropriations the establishment of
	such a system of maintenance as may be
	necessary in the judgment of the Director of
	Public Works on all first-class roads now
	constructed or which may be constructed in
	the future and declared as such by the Director
	of Public Works; to be allotted in proportion
	to the number of cedulas sold in each
	province in the year nineteen hundred and
	twenty-one	1,400,000.00
(h)	For the construction and improvement, and
	where necessary, for the maintenance of
	interprovincial roads and bridges, including
	roads and bridges uniting one region with
	another in the same province, or between
	provinces which, by resolution of the
	provincial board, shall guarantee by
	continuing annual appropriations the
	establishment of such a system of
	maintenance as may be necessary in the
	opinion of the Director of Public Works,
	on all first-class roads at present constructed
	or which in the future may be constructed,
	and are so declared by the Director of Public
	Works	P535,000.00
(i)	(1) For the maintenance, reconstruction, and
	improvement of the Manila North and South
	Roads traversing the Province of Rizal, parts
	of Bulacan, Laguna, La Union, and Nueva
	Ecija, including a portion of the Manila-Tarlac
	Road; the Zapote-Cavite Road, Province of
	Cavite, and the Pamplona-Pasacao Road,
	Province of Camarines Sur P333,000; (2) for
	the reconstruction and repair of road and
	bridges destroyed by flood, typhoon, fire, or
	earthquake, P100,000	433,000.00
(j)	For the construction, repair, and improvement
	of communications and bridges in such
	regularly organized provinces as shall comply
	with the provisions of section 2113 of Act
	No. 2711 and which, by resolution of the
	provincial board, shall guarantee by continuing
	annual appropriations the establishment of
	such a system of maintenance as may be
	necessary in the judgment of the Director of
	Public Works on all first-class roads now
	constructed or which may be constructed in
	the future and declared as such by the
	Director of Public Works	577,000.00

MAINTENANCE AND INVESTIGATION OF IRRIGATION SYSTEMS

 

(k)	For the preliminary investigation and survey
	of irrigation systems, waterworks, hydraulic
	power development and river control
	projects; for the survey of streams; for the
	operation, maintenance, and repair of
	irrigation systems, and for the completion of
	municipal irrigation system	297,000.00
	Provided, That the use of water for private
	land, the construction of irrigation projects,
	and the financing of the same shall be subject
	only to such rules and regulations as may be
	prescribed by the Irrigation Council, the
	provisions of Acts Numbered Eighteen
	hundred and fifty-four, Twenty-one hundred
	and fifty-two, and Twenty-six hundred and
	fifty-two, and any other Act now in force to
	the contrary notwithstanding.
(l)	For expenses of investigation of applications
	for the use of water for irrigation, water
	supply, and power systems; and for the
	adjudication of the rights to streams
	designated by the Secretary of Commerce
	and Communications	P40,000.00

CONSTRUCTION OF ARTESIAN WELLS AND WATERWORKS

 

(m)	For aid in supplying potable water in
	specially organized provinces	14,000.00
(n)	For the maintenance and drilling of artesian
	wells, including the purchase of necessary
	equipment, and for the investigation and
	construction of Insular, provincial, and
	municipal waterworks, and for the
	investigation, construction, reconstruction
	extension of baths and other sanitary
	improvements for the development and
	utilization of properly tested and approved
	mineral springs, whenever, in cases of
	provincial and municipal projects, the
	provinces and municipalities concerned
	shall adopt resolutions for the appropriation
	of funds covering the cost of one-third of
	the work	600,000.00
	Provided, That the funds appropriated by
	provinces and municipalities to cover the
	cost of one-third of the work shall be paid
	into the Insular Treasury when the Director
	of Public Works shall have paid the cost
	thereof: Provided, further, That any
	municipality or province which by virtue
	of the provisions of this Act shall incur the
	expense of an artesian well resulting in a
	failure, shall have the amounts expended
	returned to it: Provided, finally, That the
	amount allotted out of this appropriation to
	a municipality or province as Insular aid
	shall in no case exceed at one time the sum
	of twenty-five thousand pesos.

PORT AND RIVER IMPROVEMENTS

 

(o)	For the maintenance, reconstruction,
	completion, and improvement of wharves
	and piers and dredging in the specially
	organized provinces	P100,000.00
(p)	For the completion and maintenance of
	wharves, piers, retaining walls, and other
	works necessary for the protection of the
	shores of rivers or the sea; the purchase,
	maintenance, and repair of equipment for
	port works, and dredging of harbors in the
	various districts of the Archipelago	1,475,000.00
	Provided, That subject to the approval of the
	Secretary of Commerce and Communications
	and with such security as he may require
	material derived from dredging may be used
	for filling in private property at the request
	of any landowner, upon the condition that
	the coat thereof shall be paid by the owner
	of the land in annual installments not to
	extend over more than five years: And
	provided, further, That claims for damages
	due to marine accidents incidental to the
	operation of port equipment may be paid
	subject to like approval. The total of such
	payments out of funds appropriated by this
	subsection shall not exceed ten thousand
	pesos.

CONSTRUCTION, RECONSTRUCTION, AND MAINTENANCE OF TELEGRAPHS, TELEPHONES, CABLES, AND RADIOS

 

(q)	For the continuation, maintenance,
	construction, reconstruction and repair of
	cable, telegraph and telephone lines	420,000.00
(r)	For the purchase and installation of
	apparatus, machinery, and wiring in radio
	stations	127,000.00

RECONSTRUCTION AND MAINTENANCE OF LIGHTHOUSES, BUOYS, AND BEACONS

(s)	For the maintenance, reconstruction, and
	repair of lighthouses, buoys, and beacons,
	and for necessary repairs to mechanical
	equipment of lighthouses and other
	equipment	P125,000.00

	this Act — Eight million four hundred and
	eighteen thousand pesos	8,418,000.00

SECTION 2. All balances of the several appropriations made by this Act the destination of which has not yet been determined by the proper authority on June thirtieth, nineteen hundred and twenty-three, and all balances of appropriations which remain unexpended on June thirtieth, nineteen hundred and twenty-four, shall revert to the unappropriated funds in the Insular Treasury, and thereafter shall not be available for expenditure except upon appropriation by the Legislature.

SECTION 3. The sums appropriated in paragraphs (c), (g), (l), and (s) of this Act shall be available for immediate expenditure by the Director of Public Works, but those appropriated in the other paragraphs shall be distributed in the discretion of the Secretary of Commerce and Communications, subject to the approval of a joint committee elected by the Senate and the House of Representatives. The committee from each House may authorize one of its members to approve the distribution made by the Secretary of Commerce and Communications, who with the approval of said joint committee, or of the authorized members thereof may, for the purposes of said distribution, transfer unexpended portions of any item of appropriation under this Act to any other item hereunder.

SECTION 4. This Act shall take effect on its approval.
