An Act Appropriating Six Million One Hundred Thousand Pesos for Public Works

COMMONWEALTH ACT NO. 566

AN ACT APPROPRIATING SIX MILLION ONE HUNDRED THOUSAND PESOS FOR PUBLIC WORKS

SECTION 1. The following sums, or so much thereof as may be necessary, are appropriated out of the general fund in the Philippine Treasury not otherwise appropriated, to be at the disposal of the Director of Public Works, subject to the approval of the Secretary of Public Works and Communications and the provisions hereinafter set forth, for the purposes mentioned hereunder:

			A. MISCELLANEOUS
(a)	For aid for the construction, reconstruction, repair,
	improvement, extension, and completion of public
	works in the following provinces and chartered
	cities: Provided, That where appropriations are
	authorized for the construction of roads and
	bridges the provinces or chartered cities concerned
	shall provide annually the necessary appropriations
	for establishing an adequate system of maintenance
	for all provincial and city roads now in existence
	and those herein authorized, to be determined by
	the Director of Public Works:

(b)	For the establishment of a toll ferry service to connect
	San Sebastian, Samboan, Cebu, with Tampi, Oriental
	Negros, including the cost of construction of the
	ferry-boat and the initial expenses of operation and
	maintenance	P50,000.00
(c)	For such public improvements as may be authorized
	by the President of the Philippines	300,000.00
(d)	For public improvements in the Third Assembly District
	of Albay, Second Assembly District of Iloilo, Fifth
	Assembly District of Leyte, and Second Assembly
	District of Nueva Ecija, to be expended as may be
	authorized by the President of the Philippines	120,000.00
			B. HYDRAULIC INVESTIGATIONS
(e)	For making preliminary investigations and surveys for
	water supply, seawall, irrigation, and river control
	projects, including the purchase of equipment	60,000.00
(f)	For the investigation, survey, and adjudication of water
	rights, including the purchase of equipment and the
	expenses of the Committee created under Administrative
	Order No. 103	50,000.00
(g)	For making hydrographic investigations in connection
	with the study of water supply, irrigation, water power,
	and river control projects, including the purchase of
	equipment	50,000.00
			C. FLOOD CONTROL WORKS
(h)	For the construction, repair, improvement, and extension
	of the following river control projects:

SECTION 2. The following sums, or so much thereof as may be necessary, are hereby appropriated, out of the "Port Works Fund" under Act Numbered Three thousand five hundred ninety-two, as amended by Commonwealth Act Numbered One hundred thirty, not otherwise appropriated, to be at the disposal of the Director of Public Works, subject to the approval of the Secretary of Public Works and Communications and the provisions herein after set forth, for the purposes mentioned hereunder:

INVESTIGATION, CONSTRUCTION, AND IMPROVEMENT OF PORTS, LIGHTHOUSES, BUOYS, BEACONS, AIRPORTS, LANDING FIELDS, AND OTHER AIDS TO NAVIGATION

(a)	For the construction and improvement of national ports as follows:

SECTION 3. No appropriations out of the general fund provided in this Act shall be set up in the books of the Auditor General or otherwise made available for expenditure without the prior authority of the President of the Philippines.

SECTION 4. All balance of the appropriations made in section one hereof remaining unexpended on June thirtieth, nineteen hundred forty-three, shall revert to the general fund in the Philippine Treasury and thereafter shall not be available for expenditure, except upon appropriation by the National Assembly; and all balances of the appropriations made in section two hereof remaining unexpended on June thirtieth, nineteen hundred forty-two, shall revert to the "Port Works Fund" and thereafter shall not be available for expenditure except as provided in said Act.

SECTION 5. The sums appropriated in paragraphs (e), (f), and (g) of section one, and those appropriated in paragraphs (c), (d), and (e) of section two of this Act shall be distributed by the Secretary of Public Works and Communications with the approval of the President of the Philippines, but those appropriated in the other paragraphs of sections one and two hereof, except those appropriated in paragraph (c) of section one which shall be distributed as directed by the President of the Philippines, shall be available for expenditure by the Director of Public Works. All sums appropriated in section two of this Act shall be released only after certification by the Auditor General to the President of the Philippines that there are sufficient funds that have accrued under Act Numbered Three thousand five hundred ninety-two, as amended by Commonwealth Act Numbered One hundred thirty, to cover the items of appropriation herein authorized.

SECTION 6. The President of the Philippines is authorized to transfer any appropriation, or portion thereof, authorized in any item under any section hereof to any other item in the same section.

SECTION 7. The President of the Philippines is authorized to suspend or otherwise stop the expenditure of any amount herein appropriated for any purpose, or any portion thereof, whenever, in his opinion, the public interest so requires; and thereupon the funds affected by such action shall become available for any other authorized expenditure as the President may determine.

SECTION 8. This Act shall take effect upon its approval.
