SUPREME COURT MEMORANDUM ORDER NO. 05-07

AMENDING THE COMPOSITION OF THE BIDS AND AWARDS COMMITTEE FOR THE ACTION PROGRAM FOR JUDICIAL REFORM (BAC-APJR)

WHEREAS, the Supreme Court, through the Chief Justice, issued on 18 November 2003 Administrative Circular No. 60-2003 Re: Procurement Policy Guidelines and Procedures for the Judicial Reform Support Project, based and premised on the provisions of the JRSP Loan Agreement, the World Bank Guidelines on Procurement, and Republic Act No. 9184 and its Implementing Rules and Regulations (IRR);

WHEREAS, Section 6 of Administrative Circular No. 60-2003 provides for the creation of the Bids and Awards Committee for the Judicial Reform Support Project (BAC-JRSP);

WHEREAS, as provided in Section 6.1 of Administrative Circular No. 60-2003, the members of the BAC-JRSP shall, unless sooner removed for cause, have a fixed term of one year reckoned from the date of appointment, renewable at the discretion of the Chief Justice of the Supreme Court;

WHEREAS, the appointments of the BAC-JRSP were renewed after the first year of operation in Memorandum Order No. 04-2005 dated 12 January 2005;

WHEREAS, Memorandum Order No. 04-2005 also expanded the BAC-JRSP's functions to include the procurement activities of all foreign-assisted projects under the Action Program for Judicial Reform (APJR);

WHEREAS, on 07 October 2005, the composition of the BAC-JRSP was amended by Memorandum Order No. 56-2005 through the designation of a new Chairperson, conversion of the Working Chairperson into Co-Chairperson, the replacement of the FMBO representative who has retired, and the addition of a representative from the PMO as member;

WHEREAS, in Memorandum Order No. 20-2006 dated 06 February 2006, the BAC-JRSP was renamed as the Bids and Awards Committee for the Action Program for Judicial Reform (BAC-APJR) and its composition correspondingly amended;

WHEREAS, in view of several and urgent procurement activities under the APJR, it will be to the interest of the service for the composition of the Committee to be amended;

NOW, THEREFORE, the following officials are hereby designated to compose the Bids and Awards Committee for the Action Program for Judicial Reform (BAC-APJR):

Any other issuances or parts thereof which are inconsistent with this Memorandum Order are hereby repealed or modified accordingly. IaEHSD

The designations under this Memorandum Order shall take effect this Order.
