Amendment to Supplemental Guideline for Waiver of Exclusion of Minor Children Re: Office Memo No. MCL-08-006
The BI Office Memorandum No. MCL-08-006-A amends guidelines for the waiver of exclusion for minor children of Philippine ancestry. Children under fifteen years of age, who are unaccompanied by a parent but are with a grandparent, guardian, or relative, are exempt from exclusion waivers and associated fees. The accompanying adult must provide proof of the children's Philippine ancestry at the port of entry. This policy applies to all children under fifteen, regardless of their legitimacy or adoption status, and is effective immediately.

BI OFFICE MEMORANDUM NO. MCL-08-006-A
AMENDMENT TO SUPPLEMENTAL GUIDELINE FOR WAIVER OF EXCLUSION OF MINOR CHILDREN RE: OFFICE MEMORANDUM NO. MCL-08-006
Paragraphs 4 and 5 of Office Memorandum No. MCL-08-006 are hereby amended as follows: cCAIES
Minor children under fifteen (15) years of age of Philippine ancestry, who are unaccompanied by or not coming to join a parent shall be exempt from waivers of exclusion and waivers of exclusion service fees, Provided that, the children are accompanied by a Philippine grandfather, grandmother, guardian or relative, Provided further that, the accompanying grandfather, grandmother, guardian or relative submits substantive proof (e.g., birth certificate issued by the NSO or by LCR, Baptismal Certificate, other public documents acknowledging relationship) of the children's Philippine ancestry at the port of entry and, Provided finally that,the children are not otherwise, inadmissible.
For purposes of these guidelines, the term children shall refer to children below fifteen (15) years of age, whether legitimate, illegitimate or legally-adopted.
This memorandum order takes effect immediately.
