LTFRB MEMORANDUM CIRCULAR NO. 007-17

On 15 March 2017, the members of the Pre-Qualification Committee and the members of the Board conducted the Pre-Qualification Conference on the opening of proposed additional premium Point-to-Point (P2P) Bus Service as scheduled under Memorandum Circular No. 2017-005. PUB operators and prospective Applicants for the P2P packages attended and participated in the said conference and provided their queries, comments and suggestion on the said project. Thus, after considering the inputs gathered during the Pre-Qualification Conference, the Board hereby amends Memorandum Circular No. 2017-001 (Re: Implementing Guidelines in the Opening of Proposed Additional Point-to-Point Bus Services) particularly on the following items: SaCIDT
1. Item I — PREMIUM POINT-TO-POINT BUS SERVICE
1.1 Letter (d) Bus Body Make thereof shall now read as:
"Low floor entry (0.28m-0.38m) with space for one passenger with wheelchair, plus foldable or retractable wheelchair ramp at entry."
1.2 Letter (a) Operating Conditions thereof shall now read as:
"(a) Service with scheduled trips and designated off-streets stop for loading/unloading passengers. Designated off street stops for loading/unloading passengers may be distributed within the origin and destination."
2. Item II — ROUTES
2.1 Package 3 shall be unbundled as follows:

2.2 The last paragraph of Item II shall now read as:
"Peak hours are defined as 6:00 am to 8:00 am and 5:00 am to 7:00 pm. A minimum of twenty five percent (25%) of the required units should be in service within three (3) months from Notice of Selection. A minimum of fifty percent (50%) of the required units should be in service within six (6) months from Notice of Selection. A minimum of seventy five percent (75%) of the required units should be in service within nine (9) months from Notice of Selection. At least one third (1/3) of the fleet should be double-decker units except for Package 2 considering the road and geographical conditions peculiar to the routes provided under the said package. The selected operator will be required to operate an interim service under special permit using either its own units or leased/chartered units. cHECAS
3. Item III — QUALIFICATION REQUIREMENTS
3.1 Letter (b.1) of 1. LEGAL QUALIFICATION shall now read as follows:
"b.1) If corporation or partnership including joint ventures or consortia of local firms, Certified True Copies of Certificate of Registration, Articles and By-laws and latest General Information Sheet duly issued/received by the Securities and Exchange Commission. If the Applicant is a consortium, for purposes of submission on March 31, 2017, the members or participantsshall submit a sworn statement undertaking that if the Notice of Selection is issued to them, they shall bind themselves to be jointly severally and solidarily liable for any violation of the terms and condition of the CPC. However, if members of the joint venture or consortium organize themselves as a corporation registered under Philippine laws, the liabilities of such members under the CPC shall be in accordance with said laws."
3.2 Letter (a) of 3. FINANCIAL CAPABILITY QUALIFICATION shall now read as follows:
"a) Original or Certified True Copy of Audited Financial Statement not earlier than 31 December 2016 or nearest to 31 December 2016, stamped "received" by the Bureau of Internal Revenue or its Authorized Agent Banks. If the Applicant is a consortium, proof of the ability of the consortium to provide equivalent to or exceeding the financial capability requirement measured in terms of the net worth of the company or in the case of joint ventures or consortia the combined net worth of members or a set-aside deposit equivalent to or exceeding the financial capability requirement provided under the succeeding paragraph."
4. Item VI — EVALUATION OF QUALIFICATION DOCUMENTS
4.1 The 3rd Paragraph of Item VI shall now read as:
"The Committee shall submit to the Board its recommendation for the latter's approval which shall issue a Notice of Selection to the selected Applicant if the Board finds the same duly qualified."
4.2 The 4th Paragraph of Item VI shall now read as:
"The Applicant selected for each of the packages will be directed to submit an Application for the Issuance of a Certificate of Public Convenience (CPC) with the Board together with all the documentary requirements for New CPC in accordance with the LTFRB's 2017 Revised Citizen's Charter. Fifty percent (50%) of the allocated units per package should be available before the CPC shall be granted by the Board."
5. Item V — ISSUANCE OF SPECIAL PERMIT FOR INTERIM SERVICE
5.1 The One-Way Fare for Each Route as provided in the table under letter A of Item V shall be subject to the condition:
"The fares provided in the Table above are the maximum. Any reduction in fare shall be subject to the prior approval of the Board."
All other issuances or parts thereof inconsistent herewith are hereby modified, amended, or superseded accordingly.
This Memorandum Circular shall take effect immediately following its publication in a newspaper of general circulation and the filing of three (3) copies hereof with the UP Law Center pursuant to Presidential Memorandum Circular No. 11, dated 09 October 1992.
