Amendment to Article 310 of the Revised Penal Code Re: Qualified Theft

Republic Act No. 120, enacted on June 14, 1947, amends Article 310 of the Revised Penal Code concerning qualified theft. The amendment stipulates that theft committed by a domestic servant or with grave abuse of confidence, as well as theft involving specific items such as motor vehicles, mail matter, large cattle, coconuts from plantations, or fish from fisheries, will be punished with penalties two degrees higher than those specified for regular theft. This law aims to impose stricter penalties for certain types of theft to address abuses of trust and the theft of significant property. REPUBLIC ACT NO. 120

AN ACT AMENDING ARTICLE THREE HUNDRED AND TEN OF ACT NUMBERED THIRTY-EIGHT HUNDRED AND FIFTEEN, OTHERWISE KNOWN AS THE REVISED PENAL CODE, AS AMENDED

SECTION 1. Article three hundred and ten of Act Numbered Thirty-eight hundred and fifteen, otherwise known as the Revised Penal Code, as amended by Commonwealth Act Numbered Four hundred and seventeen, is hereby further amended to read as follows:

"Art. 310. Qualified theft. — The crime of theft shall be punished by the penalties next higher by two degrees than those respectively specified in the next preceding article, if committed by a domestic servant, or with grave abuse of confidence, or if the property stolen is motor vehicle, mail matter or large cattle or consists of coconuts taken from the premises of a plantation, or fish taken from a fishpond or fishery."

SECTION 2. This Act shall take effect upon its approval.
