Amendment to Art. 310 of Revised Penal Code Re: Qualified Theft
Batas Pambansa Blg. 71, enacted on May 1, 1980, amends Article 310 of the Revised Penal Code regarding qualified theft. It stipulates that theft committed by a domestic servant, with grave abuse of confidence, or involving specific high-value items (such as motor vehicles, mail, large cattle, or coconuts from plantations) will be penalized more severely. Additionally, theft occurring during disasters or civil disturbances is also subject to increased penalties. The law took effect immediately upon its approval and was published in the Official Gazette on July 28, 1980.

AN ACT FURTHER AMENDING ARTICLE 310 OF THE REVISED PENAL CODE
SECTION 1. Article 310 of the Revised Penal Code, as amended, is further amended to read as follows:
"Art. 310. Qualified theft. — The crime of theft shall be punished by the penalties next higher by two degrees than those respectively specified in the next preceding article, if committed by a domestic servant, or with grave abuse of confidence, or if the property stolen is motor vehicle, mail matter or large cattle or consists of coconuts taken from the premises of a plantation, fish taken from a fishpond or fishery or if property is taken on the occasion of fire, earthquake, typhoon, volcanic eruption, or any other calamity, vehicular accident or civil disturbance."
SECTION 2. This Act shall take effect upon its approval.
