DTI DEPARTMENT ADMINISTRATIVE ORDER NO. 13-01, S. 2013

SUBJECT : Further Amending the Revised Implementing Rules and Regulations of Act No. 3883, as Amended, Otherwise Known as the Business Name Law

 

Pursuant to Title X, Book IV of the Administrative Code of 1987 and to more effectively implement the provisions of Act No. 3883, as amended, otherwise known as the Business Name Law, the following further amend Department Administrative Order (DAO) No. 10-01, Series of 2010, as amended by Department Administrative Order Nos. 10-03, 10-08, 10-10 all Series of 2010, implementing the same Act.

SECTION 1. Subsection 13.2, Rule III of DAO No. 10-01 Series of 2010, as amended is further amended to read as follows: AcTHCE

13.2 Period of Renewal

13.2.1 Early Filing — The application for renewal of registration may be filed within three (3) months prior to the expiration of the Certificate of BN Registration. In such case, the Certificate is deemed renewed on the day following the expiry date.

13.2.2 Regular Filing — The application for renewal may likewise be filed, within three (3) months after the expiration of the Certificate of BN Registration. In such case, the 5 year-validity period of the Certificate shall be counted from the date the application is approved.

13.2.3 Late Filing — The applicant is given another three (3) months from the day following the end of the 3 month-period mentioned in 13.2.2 within which to file the application for renewal subject to the payment of Fifty Percent (50%) of the registration fee as surcharge. The 5 year-validity period shall be counted from the date the application is approved.

13.2.4 Non-renewal — Any application filed beyond the grace period mentioned in 13.2.3 shall be deemed not filed. As a consequence thereof, the Certificate of BN Registration shall be immediately cancelled from the records and will be made available for new registration to any qualified applicant, including the former registrant.

SECTION 2. Repealing Clause.

All orders, rules and regulations pertaining to the registration of BNs which are inconsistent herewith are hereby repealed or modified accordingly.

SECTION 3. Effectivity Clause.

This Order shall take effect fifteen (15) days after its publication in a newspaper of general circulation. Three (3) copies of this Order shall be sent to the National Administrative Register at the University of the Philippines Law Center. DTCAES
